There are two small areas, approximately 12 inches in diameter, of exposed ash. What is the proximity of the structural fill to receptors? Private Dwellings — yes approximately 500 ft away from fill, see Figure 1, Proximity Map. Community Centers — no. Surface Water Features 50' (Lakes, Ponds, Wetlands, Streams) — no, the pond is approximately 200ftfrom the fill, see Figure 2, Wetlands Map. None. Additional Comments: Intended end use was to construct an industrial park. Construction has not occurred site is vacant of any buildings or further development. On July 5, 2001 the Division issued a letter to ReUse Technology indicating their submittal of May 4, 2001 and June 22, 2001 appears to meet the requirements of the .1703 Rule for notification of proposed projects for beneficial use of coal combustion by-products. A letter dated September 23, 2008 certifying completion of all fill activities and compliance with all requirements of Section .1700 was submitted to the Division. Deed research revealed that the notice was recorded on October 16, 2009 in Book 86 page 85 in the Nash County Register of Deeds.
