LCID Landfill Notification approved by SWS February 27, 2008. Current Status of LCID Landfill: INACTIVE PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. This inspection was conducted at the request of the property owner, Arthur Williams, for the purpose of assessing the condition of the landfill and discussing the procedure for closure. 2. Mr. Williams stated that he had worked with a private company, Dunn, Foster and Spainhour, to develop and operate a small LCID landfill for the purpose of filling an area of his property. He further explained that Mr. Spainhour had retired, leading to the need for a new landfill operator. Mr. Williams stated that he has contracted with several other firms over the years, and that the current company operating the landfill is White Grading, owned by Jamie White. 3. Mr. Williams stated that he was concerned that the landfill was not ready for closure and had requested the site meeting and inspection to determine what actions would need to be completed before closure would be possible. 4. This LCID landfill is on a separate vacant parcel that was subdivided by Mr. Williams for the purpose of siting the landfill. 5. An older notified LCID landfill (N0664) is located on the adjacent parcel, which includes Mr. Williams' house and outbuildings. Field Inspection: 6. Based on walking the site and comparing observations with aerial photography of the site, the landfill area is estimated to be .91 acres. 7. The landfill appears to meet the buffer requirements set forth in 15A NCAC 13B .0564(9). 8. The majority of the landfill cap had recently been seeded and a newly sprouted vegetative cover was observed. Some pieces of exposed waste were visible on the flat area of the cap where seeding operations had churned up the soil. Please ensure that all waste is covered with at least 12" of clean soil, as required by 15A NCAC 13B .0566(5). Depth of cover will be verified with at least four probe holes prior to closure of the landfill. 9. A small area of the cap near the eastern slope has older, well -established vegetation, with some woody plants mixed in with the grasses. Please ensure that the landfill cap is maintained so that woody plants and trees are removed before they can damage the integrity of the cap. 10. The eastern edge of the fill area is level with the adjacent land; the western edge of the fill area is a slope that leads to the bottom of a small ravine. 11. Erosion control is accomplished by directing all surface water to the north end of the fill area and down into a small sediment basin. A drainage swale that runs parallel to the eastern edge of the landfill directs water to the basin, and the remainder of the site sheet flows to the northern end of the landfill. 12. The eastern side slope is steep and the southern half of it is covered with woody vegetation and thick brush. Please perform maintenance on the slope so that an inspection may be performed to verify the grade does not exceed a 3:1 slope, that the slope is stable, and that all waste is adequately covered, as required by 15A NCAC 13B .0566. 13. The northern slope of the landfill is very narrow and leads to a small sediment basin. Most of the slope has been graded and seeded and has new vegetation emerging. Large holes and erosion rills were observed near the bottom of the slope, as well as uncovered waste. Please perform maintenance to the slope by tracking in clean soil that will repair the erosion rills, allow the erosion control measures to function properly, and provide the required minimum of 12" of clean soil cover over the waste. 14. Black fabric, presumably remnants of silt fence, was visible sticking up through the eroded areas of the northern slope. Ensure that the silt fencing is removed from the landfill and disposed of properly at a facility that is permitted to accept it.
