Ground cover has improved and areas were recently seeded but still needs improvement. - 15A NCAC 13B .0566 (7) - Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of landfill development. A dwelling was onsite and inside the disposal are buffer. 15A NCAC 13B 0.0564 (9)(b) - The facility shall meet the following minimum buffer requirements: 100 feet from the disposal area to property lines, residential dwellings, commercial or public buildings, and wells. 3. 15A NCAC 13B .0566 (7): Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of landfill development. 4. Permit to operate Attachment 3, cover material requirements #21 states, “Within 120 calendar days after completion of the final disposal operations, the disposal area must be closed and covered with a minimum of one (1) foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. However, for ditches located on the landfill, at least 2 feet of soil cover is required between the bottom elevation of the ditches and the waste mass.” ADDITIONAL COMMENTS 1. Purpose of inspection was to follow up on corrective actions stated in the April 27, 2017 NOV Letter, which was hand delivered to Allan Casavant on May 10, 2017 and the last inspection dated November 7, 2018. 2. The permit for the Stump Hole LCID landfill expired in September of 2018. Allan Casavant, owner, decided to begin closure process at the landfill instead of applying for a permit renewal. 3. No unacceptable waste was observed during this inspection. 4. Cell 1 has been regraded and covered with soil. All trees have been removed from the cap. 5. Vegetative ground cover sufficient to restrain erosion shall be established at this facility. 6. Ensure DEMLR approves modification made to the erosion control measures at the facility. Submit revised and approved plan to Solid Waste as part of the closure process. If this has not been completed, then please do so and submit to Division immediately. 7. Corrective measures are necessary to bring the landfill into compliance and should be completed within 30 day’s receipt of this inspection report. 8. The trailer/residence needs to be moved to become complaint with buffer rules. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
