ADDITIONAL COMMENTS
1. Amanda Freeman and David Powell met at Merritt Brothers Office, no one was present at the office or on site at the time of the inspection. After visiting the site, Amanda and David stopped back by the off and discussed the findings with Donna Burton. 2. Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. Proper compaction of waste may assist in subsidence and erosion of the site.
3. Slopes should be maintained at no less than 3:1 during filling, disposal and grading activities.
4. Waste was visible through the soil in previously covered areas. Additional soil is required to properly cover the waste. Settled and eroded areas were observed on the LF during this inspection. These areas must be repaired and maintained to prevent future erosion. Additional soil is needed to ensure waste is covered. See rule reference below.
15A NCAC 13B .0566 – (4) Adequate soil cover shall be applied monthly, or when the active area reaches one
acre in size, whichever occurs first. (7) -Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of landfill development. 5. The facility shall only accept those solid wastes which it is permitted to receive. At the time of this inspection unapproved waste, cable wire and pvc pipe, was observed within the LCID working face. Remove all unacceptable waste. Unacceptable waste must be removed as soon as it is observed. See rule references below. 15A NCAC 13B .0563 – (1)(a) The facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood, and yard trash. Operations must be consistent and in compliance with the local government solid waste
management plan as approved by the Division of Solid Waste Management. 15A NCAC 13B .0101 – (22) Land clearing and inert debris landfill" means a facility for the land disposal of land clearing waste, concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood, and yard trash.
(23) Land clearing waste" means solid waste which is generated solely from land clearing activities such as stumps, trees, limbs, brush, grass, and other naturally occurring vegetative material. 6. It appears that the site has been inactive for a while. Please notify the Section should you decide to permanently close the site. 7. It is the responsibility of the owner/operator of a NLCID to ensure the site is managed according to the LCID rules. Corrective measures are necessary based on the conditions of the site at the time of this inspection. Please inform David Powell within 30 days that’s these corrective actions have been completed.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

Remove all unapproved waste from LCID waste site.
Fix slopes, soil cover and establish grass according to LCID rules.
