Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on January 15, 2020. 2. The service area for the facility is Avery County, Buncombe County, Burke County, Cherokee County, Clay County, Graham County, Henderson County, Jackson County, Macon County, Madison County, McDowell County, Mitchell County, Polk County, Rutherford County, Swain County, Transylvania County, and Yancey County. 3. The facility is owned by Haywood County and operated by Santek Environmental of North Carolina, LLC. Records Review 4. The permit and operations plan were available for review upon request. 5. Yearly tonnage for calendar year 2019 was provided for review. The facility disposed of 157,769.3 tons of waste, which is within the maximum variance allowed by GS 130A-294(bl)(1) of the permitted amount of 146,000 tons. 6. Asbestos disposal and special waste/waste determination records for 2019 were available for review. 9. Random waste screening forms from January 19, 2019 to December 31, 2019 were reviewed and found to be complete. Waste screening forms showed the final disposition of any unacceptable waste that was found in incoming loads. 10. Landfill gas monitoring was conducted on March 7, 2019, May 1, 2019, September 7, 2019 and November 22, 2019 and no exceedances were noted. Monitoring was done by Robert Hudson on March 7tt', September 7' and November 22" d; the May 1st testing was conducted by Nick Walker. 11. Leachate hauling logs were reviewed. Records indicated that the facility hauled 4.85 million gallons of leachate to the Town of Waynesville Wastewater Treatment Plant during calendar year 2019. 12. Groundwater monitoring was conducted by SCS Engineers on October 29-31, 2018 and April 10-11, 2019. Both monitoring reports had exceedances of the 2L standard. Leachate testing is being conducted concurrently with groundwater monitoring. Operations Inspection of the MSWLF Unit (4407-MSWLF-1993) 13. The facility is currently operating in Phase 4. 14. The facility received 7.25 inches of rain from January 1 to January 15, 2020. 15. The working face appeared to be of manageable size and no unapproved material was observed. 16. The top of the landfill lift and the side slopes were observed to have good soil cover. A small amount of waste that was tracked by equipment was visible on the lift. 17. Windblown litter was minimal and was well managed at the time of inspection. 18. Rill erosion was observed on the western slopes of Phase 2. Ensure rill erosion is repaired and seeded before waste is exposed and to prevent future erosion issues. 19. An edge of waste marker was observed to have been knocked down on the northwest side of Phase 4. Monitoring wells MW IA, MW 2, MW 2D, MW 4A, and MW 16 were observed to be locked. 21. The leachate pond had adequate freeboard and no visual deficiencies were noted in the liner. Ouerations Insuection of the Mulching and Grinding Treatment and Processing Area 22. The Mulching and Grinding Treatment and Processing Area is located to the south of phase 2 of the MSW landfill. 23. The facility accepts unpainted, untreated wood, brush and unpainted/untreated pallets for grinding. 24. Leaves were noted in the unground stockpile. If leaves are accepted, ensure that operations comply with the requirements of 15A NCAC 13B .1406. 25. A small amount of unacceptable wastes (tarp, plastic garbage bags) was observed in recently dumped loads of material. Please remove the unapproved material and dispose in the proper location. Inspection of the Closed Construction and Demolition Landfill (4407-CDLF) 26. The construction and demolition landfill stopped receiving waste on June 30, 2008. 27. Edge of waste (EOW) markers constructed of a metal T-Post and sign were installed around the perimeter of the landfill. 28. Some woody vegetation was observed on the landfill near the drainage ditches that carry storm water off of the cap. The woody vegetation issue was discussed with staff during the inspection. On Friday, January 171h, the facility sent photos showing that the woody vegetation had been removed from the landfill cap. Continue to remove woody vegetation that grows on the landfill cap as needed. 29. The landfill cap was observed to have good vegetative cover and appears to be mowed on a regular basis.
