STATUS OF PERMIT:
Permit to Construct MSWLF Phase 3 and Operate MSWLF Phase 1, 2, and 3 (Calls 5A and 6A) was issued August 20,
2018. In accordance with North Carolina General Statute 130A-294(a2), permits for sanitary landfills and transfer
stations shall be issued for the life -of -site of the facility unless revoked.
PURPOSE OF SITE VISIT:

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
Upper Piedmont Regional Landfill, 7304-MSWLF-1997, is permitted to operate Phase 1 (Cells IA, 2A, 3A, and 4A),
Phase 2 (Cells 1B, 2B, 3B, and 4B) and Phase 3 (Cells 5A and 6A) of the municipal solid waste landfill.
The following items were observed during the inspection. Compliance issues are noted in bold and require action
within 30 days; I will re -inspect in March 2020 to observe progress.
1. The upper tier of the north, west and southwest slopes of the landfill has little to no vegetative cover due to
reworking of the slopes that occurred in December 2019. The slopes were sliver filled to reach final grade.
2. Erosion rills are present at the northwest corner of the landfill. Additional soil must be placed in these areas
prior to establishing vegetative cover.
3. Additional soil cover is needed at the southwest corner of the landfill. Mr. Gustin said the facility has
arran ed to have a contractor cover the slo e in the next week or two. The facility has been short-staffed.

4. All required sedimentation and erosion control measures must be installed and operable to mitigate
excessive on -site erosion and to prevent silt from leaving the area of the landfill unit during the service life
of the facility. The sediment basin on the southwest side of the landfill needs to be mucked out in order to
5. The facility is approved to accept an average maximum annual disposal rate is 660 tons per day, 365 days per
year, or 240,900 tons per year in accordance with the franchise approved by Person County Board of
Commissioners. The facility is looking to increase that amount to 780,000 tons per year but must first widen the
exterior road to create a turn lane. Prior to increasingtonnage, the facility must submit these changes to Solid
Waste Permitting Branch for approval.
6. The following records were reviewed:
a. Waste screening (random load) inspections for July 1, 2019 through January 20, 2020.
b. Leachate collection system cleaning on May 2, 2019 and September 25, 2018.
c. Groundwater and surface water monitoring in May 2019 and October 2019.
d. Leachate sampling in February 2019 and June 2019.
e. Landfill gas monitoring (done monthly) for September, October, November, and December 2019.
f. Alternative daily cover logs for September 1, 2019 through December 31, 2019.
7. The facility operator completed an approved operator training course in compliance with NCGS 130A-309.25. A
responsible individual certified in landfill operations was on -site during the inspection. The following individuals
are NC SWANA Certified Landfill Operations Specialists:

Bull fencing and temporary fencing is used to catch windblown materials. A clean up crew was onsite during the
inspection picking up windblown waste on the landfill. No windblown waste was observed outside the landfill
footprint. Good job!
9. The facility is permitted to use Posi-Shell, tarps or synthetic cover, and petroleum contaminated soil (PCS) as
alternative daily cover (ADC). Posi-Shell is used during the week and tarps on the weekends. Petroleum
contaminated soils are used as cover as they arrive. Once a week, the entire working face is covered with soil.

10. This facility is approved to receive white goods; however, it is no longer accepting these items since Person
Industries is now taking them. Please make sure to update your Operation Plan with the Solid Waste Permitting
Branch to notify them of this change.
11. Edge of waste/liner markers were present.
12. The site is secured by a gate and fencing.
13. A sign at the entrance lists the permit number, unacceptable wastes, hours of operation, and emergency contact
numbers.
14. Interior roadways are of all-weather construction and maintained in good condition.
