Dear Mr. Pharr and Rocky River Presbyterian Church:
The UST Section, Division of Waste Management (DWM), Mooresville Regional Office (MRO)
received the January 9, 2019 Initial Abatement Report on January 15, 2019. The report recommending
historic release(s) clean-up and vertical extent cleanup of soil contamination in relation to the December
20, 2018 release clean-up was reviewed and approved on January 24, 2019. The paper report copy will
be maintained in the MRO. The electronic copy has been loaded to the electronic document storage
system (Laserfiche). Records indicate that you are the owner or operator of this UST system. Therefore,
as a responsible party, you must comply with the initial response and abatement action requirements of
Title 15A NCAC 2L .0404 and, if applicable, the assessment and reporting requirements of Title 15A NCAC
2L .0405, within the timeframes specified in the attached rules. (Be aware that if the latter rule is
applicable, you must comply with its requirements even if you do not receive formal notification from the
UST Section.)
The report indicates:
• An unknown amount of heating oil #2 was released from a fuel delivery truck overfill of a heating oil
underground storage tank (UST) from the bent pipe of the tank and displaced onto the ground. A rainfall event
at the time caused the heating oil to spread away from the vent pipe area.
• Initial soil cleanup actions occurred on December 24, and 26-27, 2018.
• The vertical extent of cleanup was limited due to the UST remaining in place along with two adjacent air
conditioning units and underground utilities.

• The release had also entered into the furnace room through the brick wall located adjacent to the UST.
Within the furnace room, there are two floor drains that the release may have entered.
• Shield collected post -excavation confirmation soil samples during cleanup activities. Four post -
excavation soil samples (S-1 through S-4) were taken from areas representative of the cleaned up area.
• On December 27, 2018 the oil stained walls, floor, and floor drains within the furnace room were sprayed
with bioremediation fluid. On December 27, 2018, the source area was also sprayed with a
bioremediation fluid, covered in plastic sheeting to restrict rainwater from migrating contamination from
the source area impacted soils, and the entire excavated are was backfilled.
• During the excavation work, grey -green soil was found in the vicinity of the fill and vent pipes of the UST
indicating that a historic release or releases had occurred. Where historic release(s) impacted soil
comingled with the new release it was excavated. In areas around the air conditioning units and close to
the church wall where only the historic release(s) was/were evident, soil was not excavated. Also, when
the top of the UST was encountered or the two underground electric utility lines in the area were
encountered, additional soil was not excavated.
This site will remain an open UST incident until contaminated soil has been removed or shown to
be below residential maximum soil contaminant concentrations (MSCCs) established in Title 15A NCAC
2L .0411. Because a release or discharge has been confirmed, a Licensed Geologist or a Professional
Engineer, certified by the State of North Carolina, is required to prepare and certify all reports submitted
to the Department of Environmental Quality in accordance with Title 15A NCAC 2L .0103(e) and 2L
.0111(b).
Please note that before you sell, transfer, or request a "No Further Action" determination for a
property that has not been remediated to below "unrestricted use" standards, you must file a Notice of
Residual Petroleum ("Notice") with the Register of Deeds in the county where the property is located
(NCGS 14313-279.9 and 14313-279.11).
