Dear Mr. Parnell: The Solid Waste Section has reviewed Mr. Bill Meyer's (Meyer's Environmental Consulting LLC) assessment of risk factors for the proposed Recovery Center property located next to the closed Wilder's Grove Landfill. Mr. Meyer concluded that there is "no unreasonable short or long term risk, with regard to the adjacent landfill..." As you may be aware, groundwater contamination was found at the site and the landfill is generating the explosive gas methane as the waste decomposes. In response a groundwater investigation was done to determine the extent of the contamination and the landfill has a methane collection system to extract the gas for use at a nearby industrial facility. Corrective measures are now being reviewed for possible future remedial actions to restore the groundwater quality. In addition, gas monitoring wells are sampled for the presence of methane on a quarterly basis at landfill boundary to insure that concentrations do not exceed the regulatory limit. The Solid Waste Section does not have any assessment or remedial plans that would involve the proposed Recovery Center property. However as a safety precaution, the agency recommends the installation of permanent continuous explosive gas alarm systems in all buildings constructed on the property. The Report directed the City to submit a "report with certification documenting the process and measures taken to prevent damage to the synthetic liner during repair of the settled area" within ten days of the audit. The main focus of the Audit Report was on a subsidence area located in the central portion of the landfill to the south and west of the haul road. The area is situated near the crest of the landfill slope in an area that was last filled in 1997. A site plan showing the impacted area is attached. As the Section is aware, the subsidence is a result of normal landfill settlement and the presence of a subsurface fire. City personnel have been placing soil in this area in response to observed subsidence for the last two years. On June 10, 2004 a Hazen and Sawyer engineer went to the site to observe existing conditions. The size of the total disturbed area was measured using a tape measure and is calculated to be approximately 1.5-acres. This area includes locations where soil is currently stockpiled, access areas, and areas where soil was previously placed and spread. Based upon our observations and information provided by City staff, the area that is known to have subsided is considerably less than 1.5-acres but has not been determined at this time. Evidence of minor subsidence (e.g., 1 to 2-ft.) was observed in small localized areas to the north of the disturbed area. Due to the field conditions and the likely presence of a subsurface fire, it is not possible to provide a complete evaluation and certification of the condition of the final cover at this time. The City excavated four test pits along the north and west perimeter of the area. The approximate locations of the test pits are shown on the attached site plan. The liner system was in -tact at all the test pit locations. The depth of soil cover over the Geomembrane ranged from 18 to 64-inches. Clearly more test pits are needed to completely evaluate the subsidence area and identify any damage to the geosynthetic components of the final cover. On the basis of the history of the area and surface observations, it can be concluded that at least a portion of the 1.5- acre disturbed area will require repair to the liner system. Such repair could include complete removal and replacement or merely re -grading to re-establish positive drainage. The main emphasis should be to monitor the subsidence area and to place and compact soil as necessary to minimize pathways for oxygen intrusion which could provide fuel to the fire. The surface of the soil should be graded to maintain positive drainage and minimize infiltration into the refuse. This is the most practical means to control a subsurface fire. During this time it is recommended that investigation into the extent of the fire and the condition of the final cover components in the subsidence area be completed. Hazen and Sawyer has recommended to the City of Raleigh that the following activities be completed: 1. Establish a series of benchmarks around the perimeter of the subsidence area on 50 to 100-foot centers. These points should be established by survey methods and given identifying marks so they can be used to locate subsidence or repairs in the future. 2. Monitor the subsidence area on a weekly basis to look for evidence of a subsurface fire, subsidence, ponding of surface water or erosion. Prepare weekly reports of conditions observed and repairs made. 3. Excavate a series of test pits to expose the final cover geosynthetics and record the depth of soil cover. Survey the location of each test pit. Using this information, determine the nature and extent of final cover damage, if any. 4. Direct Natural Power, Inc. to repair any gas line excavations that are open. We understand from City staff that the lines exposed are all above the synthetic liner. 5. Direct Natural Power to inspect geomembrane boots at each of its wells to make sure the boots are still properly connected to the gas well riser pipe. Make necessary repairs to the boots. Install a series of probes at varying depths around the perimeter of the subsidence area in an effort to determine the lateral and vertical extent of the fire. Survey the probe locations. 7. Meet with DENR Solid Waste Section staff as soon as possible to establish a schedule to effectively manage the landfill fire while maintaining the integrity of the final cover. Once the subsurface fire is better identified and the limit of damage to the final cover is established, we recommend that City hire a contractor to excavate soil in the affected areas, replace final cover components, place new cover soil and re -seed the area. It is not recommended that any major excavation be conducted in the subsidence area until the extent of the subsurface fire is established. During the audit, we observed an area on the south west portion of the closed landfill where it appears that approximately t/o to %2 acre of the landfill cap has recently had fill soil added. In a conversation with Mr. Jimmy Johnson the same day, he indicated that the soil was used to fill an area where the landfill had settled. North Carolina Solid Waste Management Rules 15A NCAC 13B Section .1627 (d) (1) (A) states as follows — (d) Post -closure criteria. (1) Following closure of each MSWLF unit, the owner or operator shall conduct post -closure care. Post- FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 2 of 2 closure care shall be conducted for 30 years, except as provided under Subparagraph (2) of this Paragraph, and consist of at least the following: (A) Maintaining the integrity and effectiveness of any cap system, including making repairs to the cover as necessary to correct the effects of settlement, subsidence, erosion, or other events, and preventing run- on and run-off from eroding or otherwise damaging the cap system. The portion of the landfill in question was closed and capped with a synthetic liner. In order to ensure that the cap system has not been damaged during this filling activity, within 10 days of receipt of this audit report submit a report with certification documenting the process and measures taken to prevent damage to the synthetic liner during repair of the settled area. Certification indicating the current condition of the synthetic liner, i.e. whether or not the synthetic liner has been damaged should also be included in the report. A small leachate outbreak was observed approximately half way down the haul road on the south east side of the landfill. This should be repaired within 10 days of receipt of this audit report. 3). Several ditches have been excavated and left uncovered on the top portion of the landfill which appear to be above some of the methane gas system lines. These ditches will allow surface water to infiltrate the cap system and should be repaired as soon as possible. 4) The Operating Record for required quarterly methane monitoring results, financial assurance documents, ground water monitoring etc... was not reviewed during this audit. Code 13B, I conducted a compliance inspection on November 8, 1993 of the Wilders Grove Landfill located on Hwy 64, Raleigh, North Carolina. The inspection found the landfill to be in violation of certain requirements of the North Carolina Solid Waste Management Rules, codified at 15A N.C. Admin. Code 13B specifically: 1) 15A N.C. Admin. Code 13B .1626 (2) (a) requires that all Municipal Solid Waste Landfill units must cover waste with six inches of earthen material at the end of each working day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging. At the time of this inspection, and my previous inspection of May 5, 1993, the facility was not properly covering the waste as required by 15A N.C. Admin. Code 13B .1626 (2) (a). Based on the foregoing, the City of Raleigh is hereby ordered to immediately comply with 15A N.C. Admin. (d) The removal of solid waste from a sanitary landfill is prohibited unless the owner/operator approves and the removal is not performed on the working face. (e) Barrels and drums shall not be disposed of unless they are empty and perforated sufficiently to ensure that no liquid or hazard- ous waste is contained therein. The City of Raleigh Sanitary Landfill was operating in violation of 10 NCAC 10G.0503(2)(a)(ii) in that the concentration of explosive gases consistently exceeded the lower explosive limit when measured with a GP-204 Gas Tech Portable Combustible Gas Indicator at the location marked "LEL TEST." A. The test was repeated to verify results. Based on the foregoing, the City of Raleigh is hereby ordered to initiate the following two-phase program, to correct the violation as stated in this Notice of Violation, and otherwise be in compliance with the North Carolina Solid Waste Manage- ment Rules, codified at 10 NCAC 10 G: Phase I Phase I is an initial monitoring program which will assess the magnitude of the violation. During this inspection I was vary impressed with the operation of the site - both daily and overall operation. The site was in very fine condition related to cover and compaction. Seeding and erosion control in the recently developed areas ryas top-notch. Also, the recent purchase of the farm -type tractor and related equipment indicates that Raleigh City plans to continua to keep this landfill in top shape. I want to take this opportunity to commend you and your staff for the fine work and management that has gone into this facility. It is obvious that Max Weininger. Charles Hamilton, Matthew Richardson and the entire landfill staff have gone all out to maintain the landfill in "clean inspection sheet" status. The Raleigh City Landfill has steadily improved since I became inspector two years ago, but lately the condition has been much improved. Mr. Mitchell Duke of the Wake County Health Department was present during the inspection. The following requirements were discussed with Mr. Baird on site. 1. Waste was not restricted to the smallest area practical. 2. Waste was not being properly compacted (it is our understanding that the specialized compactor is to be on site soon as it has been out of service for the past month for repairs.) 3. Six inches of daily cover was not being applied. 4. The final two feet cover had not been applied to completed areas. 5. Surface drainage was not being controlled as required. 6. Blowing Paper was not being controlled as required. REQUIREMENTS: I. The above deficiencies are to be corrected to bring the operation into compliance with the N.C. State Board of Health "Rules and Regulations Providing Standards for Solid Waste Disposal." 2. Prepare operational plans for the remainder of the site as the presently approved operational area will be exhausted within 45 days. RECOMMENDATIONS: 1. It is recommended that tires being received at the site be either cut or shredded in order to preserve space and to permit the placing of the tires with the other solid waste.
