Reference: Inspection of two underground storage tanks (USTs) located at 800 Mohigan
Street, Charlotte, North Carolina
Cedar Rock Project # 285222590
Dear Mr. Chipps:
Cedar Rock Environmental, P. C. (Cedar Rock) performed a site inspection on December 19, 2019
at the above referenced location. The purpose of the inspection was to determine if the UST
previously used for storing fuel has leaked causing significant contamination of the underlying
soils. It is our understanding the residence was built in 1953 which is most likely when the oil
heat system and original UST was installed.
An inactive UST (T1) was discovered to be located parallel to and centered approximately 4.3 feet
off the northwest foundation wall and about 10 feet southwest of the northern foundation corner
of the house. Both the fill and vent pipes of T1 were observed to be intact. The depth to the top
of the UST is approximately 18 inches below land surface (bls). The UST has a length of about
75 inches with a diameter of approximately 46 inches and a capacity of about 540 gallons. The
UST was measured to contain approximately 181 gallons of fluid. White flagging was installed
to mark the ends of the UST.
Once the orientation of the UST (T1) was determined, two soil borings were performed, one at
each end of the UST using a 3.25-inch diameter stainless steel hand auger. The soil boring at the
northeast end of the T 1 was advanced to a depth of approximately 6.6 feet bls, about 1.3 feet below
the bottom of the UST. No soil contamination was observed in this boring. A second soil boring
was performed at the opposite end of T1. A slight petroleum odor was observed at a depth of
approximately 4.8 feet and exhibited local discoloration indicating that some tank leakage had
occurred. The soil at the base of the boring at a depth of 6.6 feet bls exhibited no petroleum odor
suggesting T 1 is in the early stages of leakage but has not yet significantly impacted the underlying
soils. The native soil underlying T1 consists of a reddish -brown sandy silt.
A metal detector was used to survey the outside perimeter of the house where USTs are most likely
to be located. In such manner, a second UST (T2) was discovered to be located parallel to and
centered approximately 6.0 feet off the southwest foundation wall and about 11.2 feet southeast of
the western foundation corner of the house. Both the fill and vent pipes of T2 were missing. The
depth to the top of T2 is approximately 19 inches below land surface (bls). The UST has a length
of about 98 inches with an estimated diameter of approximately 40 inches and an estimated

capacity of about 530 gallons. No access was available to measure tank contents. White flagging
was installed to mark the ends of the UST. UST T2 is likely to be the original UST installed with
the oil heat system. UST T1 would probably have been installed to replace T2 when it began to
take on water through corrosion holes in the UST.
Once the orientation of the UST (T2) was determined, a single soil boring was performed at the
northwest end of the UST. The soil boring was advanced to a depth of approximately 6.8 feet bls,
about 1.9 feet below the estimated bottom of the UST. A moderate petroleum odor was observed
in the soils from a depth of approximately 5.0 to 6.8 feet bls suggesting the UST has significantly
impacted the underlying soils. The native soil underlying T2 consists of a light brown sandy silt.
A soil sample (CR-1) was collected from the base of the boring and will be submitted for laboratory
analysis, if required.
No other USTs on the property were discovered using a metal detector to survey the outside
perimeter of the residence where USTs are usually located. Two pairs of copper fuel
delivery/return lines were observed in the crawlspace to be severed. No petroleum odor or staining
was observed in the crawlspace. The property is currently serviced by a municipal water supply.
No water supply wells were observed within 150 feet of the petroleum release. For this reason,
the property should be classified as "Low Risk" by the State.
Based on the results of this investigation, significant contamination of the soils underlying UST
T2 has been confirmed. It was also confirmed that UST T1 has begun to leak. Current law (NCGS
143-215.85 (a) and (b)) requires that any significant release of contamination be immediately
reported to the North Carolina Department of Environmental Quality (DEQ), Division of Waste
Management, Mooresville Regional Office (704-663-1699). According to State law, upon
reporting the release, the current property owner where a release is discovered is identified by the
State as the "Responsible Party" for any State required action relating to the UST leakage. Upon
the request of the property owner, Cedar Rock will submit a UST-61 form to satisfy the State's
notification requirement for the release.
Currently, the property cannot be legally conveyed until a Notice of Residual Petroleum (NRP) is
filed with the Mecklenburg County Register of Deeds office pursuant to NCGS 14313- 279.11
(d). The NRP will contain applicable land use restrictions to minimize the risk of exposure to
existing contamination. The land use restrictions prohibit any disturbance of site soils within a
specified radius of the estimated extent of soil contamination and prohibit the future operation or
installation of any water supply wells on the property. Once classified as "Low Risk" and an NRP
has been approved, the DEQ will issue a "Conditional" Notice of No Further Action (NFA) letter
to formally close out the release incident. The "Conditional" provision in the NFA letter will be
removed upon receiving a certified copy of the filed NRP and the completion of Public
Notification requirements. Filing the NRP will not be required if all soil contamination exceeding
applicable standards has been removed.
The State currently will not require any initial abatement or remedial action regarding the release
of heating oil from a UST on a "Low Risk" property. However, once the presence of the USTs
and confirmed contaminated soil is disclosed to other interested parties as required by State
law, future buyers, homeowner's insurance providers, or lenders may require initial abatement
and/or remedial actions relating to the USTs prior to making any commitments towards the

property. In addition, there exists a potential for further environmental impact to the property from
continued leakage from the USTs.
Currently, the presence of the soil contamination does not appear to pose any known health risk.
Attempting to remove the USTs and associated contaminated soils is costly, would be disruptive
to the property, and may not result in a clean closure. For these reasons, we recommend the in -
place abandonment of both USTs to prevent further leakage. This would consist of exposing a
portion of each UST by hand excavation, cutting a hole about two feet in diameter on the topside
of each UST, removing all UST and fuel line contents, cleaning the interior of the USTs, and filling
the USTs with an excavatable flowable fill cement slurry. A summary report signed by a licensed
geologist would be generated that would include photographs of each step of the abandonment
process, including a photograph of the interior of each UST to show the USTs were properly
cleaned. Cedar Rock can provide this service for a charge of $4,900.00 plus $1.25 per gallon of
recovered fluids. Preparing and filing the NRP and performing the Public Notification
requirement will cost an additional $1,250.00.

I have attached the signed NRPs and added the word Mecklenburg in the specified blank
as per your request. I have also attached a copy of our inspection report for each of these
sites which states that no wells were observed within 150 feet of the release and that both
sites should be classified as Low Risk. The reports are both signed and stamped by a
licensed geologist.

I received the UST-61s for both sites by email. I have not been sent receptor information that
has been signed and sealed by a licensed geologist or professional engineer. These sites will
have unknown risk classifications until this information has been received or until I have time
to visit each site to gather receptor information. Keep in mind that each UST Project manager
is allowed 2 hours per week for noncommercial work.
