No permit required. PURPOSE OF SITE VISIT: Follow up Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: Remediation is being conducted to achieve compliance of past violations. OBSERVED VIOLATIONS No new violations observed during this inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS; 1 - The land on which this landfill is located is owned by H.D. Newbern and Finley S. Newbern and recorded in Book 401 page 46 of the Currituck Co. Register of Deeds. 2 - The Notification was recorded on July 24th, 1997 in Book 413 Page 825 of the Currituck County Register of Deeds. 3 – Site has locking gate for security. 4 - The road is in good condition. Constructed of rock and sand for all-weather conditions. 5 – Currently the facility is Digging up Land Clearing Debris from pond area. Stockpiling the debris to dry the dirt before grinding. 6 – Edge of Waste Markers have been installed, John College still needs to measure the footprint to ensure compliance. 7 – During this inspection, it was discussed if the Notified LCID could be expanded to a Permitted facility to ensure there is enough room to store the Land Clearing Waste. It was determined that the Notified LCID would have to be used for the Land Clearing Waste being dug from the pond area. When this material is ground up, it will take less room on the Notified LCID than if it was not ground up. 8 - Items listed were discussed with H.D.
