Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. The construction and demolition landfill (CDLF) ceased operation on June 30, 2008. 2. The closed CDLF is located atop a closed municipal solid waste landfill (MSWLF). 3. Prior to operating as a CDLF, the facility operated as an unlined sanitary MSWLF which consisted to two units. The first unit was closed prior to October 1991 and the second unit closed prior to December 31, 1998. 4. A gate was provided at the entrance to the facility to prevent unauthorized access. 5. Majority of the landfill cap was stabilized with native vegetation. However, the top and side slopes were in need of mowing to allow for a thorough inspection for settling and leachate concerns. Mr. Southard explained that mowing of the landfill cap had been delayed to allow for establishment of vegetation in those areas that had been regraded earlier in the year. Please ensure that the landfill cap is mowed regularly to allow for a thorough inspection. 6. The western slopes had been regraded earlier in 2015 to repair areas of washing according to Mr. Southard. All disturbed areas had been reseeded with some germination of seed. However, majority of groundcover was insufficient to control erosion at the time of inspection and some areas were bare of vegetation. Please continue efforts to stabilize all bare areas and those areas with sparse vegetation with a groundcover sufficient to restrain erosion. 7. Many of the diversion ditches designed to divert water upon completion of grading activities were severely eroded. All eroded diversions should be regraded and measures provided to prevent further erosion within the channels. This can include, but not be limited to installation of check dams to slow flow within the ditches. Efforts should also be made to stabilize the ditches to prevent erosion. 8. Edge of waste markers consisting of white PVC posts were in place at the time of inspection. 9. Two small patches of tree saplings were observed on the south side of the landfill near the crest of the side slope. These trees should be removed from the landfill cap. 10. Semiannual groundwater monitoring was being performed. Monitoring records for the first semiannual sampling event for 2014 (performed 5/29/14), second semiannual sampling event for 2014 (performed 10/24/14), and the first semiannual sampling event for 2015 (performed 5/14/15) were verified. Sampling for the second sampling event for 2015 were performed on 11/5/15, but results had not yet been received. 11. Quarterly methane monitoring was being performed. Records for events performed on 2/6/15, 6/11/15, and 11/5/15 were verified. No exceedances above applicable standards were found. A fourth sampling event is to take place in December.
