Mr. Chao, 

After deciding to stop receiving waste at the Alamance County C&DLF in September of 2017, we immediately complied 
with the requirement of placing intermediate cover. We continue to monitor the cover to verify compliance, as well as 
surface water, ground water and gas migration. 

We have continued to keep Phase 1 and 2 available for possible use in the case of an unforeseen event. If we have not 
utilized the C&DLF by the time construction of the next MSW cell begins in the next few years, will plan to employ the 
selected contractor to close the C&DLF. 

Let me know if our planned actions are acceptable to NCDEQ.

Dear Mr. Hill:

While preparing the NC Solid Waste Management Annual Report for FY 2018-2019, the Solid Waste Section
(SWS) notices that Alamance County C&DLF, Permit No. 0104-CDLF-1993 did not received any permitted
C&D wastes in the FY 2018-2019. The recent Facility Compliance Inspection Report confirmed that this
C&DLF unit has been inactive since September 18, 2017. According to the SWS records and the permit (DIN
25364) dated December 10, 2015, the County operated the C&DLF unit – Phases 1 and 2 which encompasses
6.32-acre waste footprint.
After receiving this e-mail notification, Alamance County (the County) shall immediately place intermediate
cover over the inactive landfill area where shall be stabilized with vegetative ground cover or other stabilizing
material according to Rule 15A NCAC 13B .0542(f)(2). Upon completing installation of the intermediate
cover, the County should inform the SWS in writing and the written notation shall be placed in the facility
operating record.

According to data stated in December 17, 2018 e-mail message, the C&DLF unit – Phases 1 and 2 has in-placed
waste volume of 372,500 cubic yards (CY), which exceeded the permitted gross capacity of 219,731 CY for the
Phases 1 & 2 (DIN 25364). The approved facility plan (DIN 25366) of this landfill unit stated the landfill unit
has an approved gross capacity of 415,000 CY. Based on the above-referenced data, the remaining capacity
(waste plus the landfill cover system) of the landfill is approximately 38,000 CY.

Because the Alamance County C&DLF unit has remaining capacity of 380,000 CY and ceased waste disposal
activities more than a year, pursuant to Rule 15A NCAC 13B .0543(c)(5)(C), the SWS determines that
Alamance County shall begin closing the C&DLF unit according to Rule 15A NCAC 13B .0543(c)(5) and the
approved closure plan (DIN 25366) within 30 calendar days (No later than December 12, 2019) after receiving
this notification.

Pursuant to Rule 15A NCAC 13B .0543, the County may request the SWS an approval of an extension of the
closure activity by submitting a written request, which, in a minimum, should include the acceptable causes for
postponing the rule-required closure activities, the new closure schedule, and the detailed continuous efforts to
be made for preventing threats to human health and the environment from the unclosed C&DLF unit.

Hi Wayne:

According to your calculation and updated info in the e-mail message, the constructed and operational volume
for Phases 1 & 2 of the C&DLF unit are:

Constructed volume (air space + cap) = 410,500 CY
Volume used (in-place waste volume as of the date submitting 2017-2018 Annual Rpt) = 372,500 CY

I would think the data is acceptable for this year annual report. No overfills the landfill unit at this time.

BUT, I believe there is a bigger problem, or I should say the Facility Plan must be overhauled in the near
future.

The approved gross capacity (air space + period cover + final cap) for this C&DLF unit = 415,000 CY (This
amount was approved by a local government approval processes [DIN25366])

The constructed volume/interim capacity (Phase 1+2) = 410,500 CY
The remaining gross capacity for this C&DLF unit = 415,000 CY - 410,500 CY = 4,500 CY

This 4,500 CY is the only capacity left for the future development (either lateral or vertical developments) for
this C&DLF unit. But it is likely no Phases 3, 4, & 5 as described in 2015 Facility Plan any more. Of course,
the County can go through another local government approval processes (substantial amendment to the permit
per NCGS 130A-294(b1)) for increasing more capacity than the current approved one (415,000 CY). This
permit action will considered as a new permit per NCGS 130A-294(a3)(1); therefore a permit fee is required per
NCGS 130A-295.8.

By the way, the PTC for Phase 3 of the C&DLF unit (DIN 25364) has expired on June 16, 2017. The issuance
of PTO for Phase 3 is an administrative error; therefore, the Solid Waste Section revokes the PTO for Phase 3
of the C&DLF unit (DIN 25364).

Per our discussion last week, we calculated the available air space for Phases 1 and 2 of the CDLF.  We used the 
subgrade drawing provided in the initial permit produced by Hazen‐Sawyer with the above grade as‐built topography 
determined by the last annual survey. Our volume used is 372,500 cubic yards with approximately 3,000 cubic yards 
remaining on top.  The cap will require approximately 35,000 cubic yards.  Therefore, the total volume of Phases 1 and 2 
is 410,500 cubic yards including the capping material. 

Phase 3 has yet to be developed and may never be developed.  The available volume for it remains 66,859 cubic yards 
without capping material. 

I hope this will satisfy any discrepancies and if you need additional info or have questions, please let me know.
