STATUS OF PERMIT:
Active. The Small Type I Facility currently operates under active Yard Waste Notification (YWN) #11-037.
PURPOSE OF SITE VISIT:
Partial Facility Inspection.
STATUS OF PAST NOTED VIOLATIONS:
None.
OBSERVED VIOLATIONS:
1. 15A NCAC 13B .1404(a)(2) states: "A 100-foot buffer shall be maintained between all property lines and
compost areas for Type 3 and 4 facilities, 50-foot buffer for Type 1 or 2 facilities."
During this inspection, it appeared the Small Type I facility had not maintained the required 50-foot property line buffer at
the facility, especially along the northern and northeastern property boundaries (photos #1 & #2). As discussed with the
Owner and Site Manager during this inspection, unprocessed and processed materials were observed within what
appeared to be the 50-foot property line buffer, near the site entrance and along the site access road.
To achieve compliance, within 30-days of receipt of this Facility Compliance Inspection Report, the facility must
demonstrate that the required 50-foot property line buffer is maintained for the Small Type I facility. As discussed
during this inspection, as well as the previous inspection conducted on October 12, 2018, to ensure minimum
buffers are maintained at the site, property line buffer stakes, markers, and/or flagging should be installed and

maintained at the facility. A follow-up inspection will be conducted to observe facility property line buffers.

each side of Mimidis Lane appear to be within the 50-foot
property line buffer.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The Section received a complaint regarding the facility's potential property line buffer encroachment onto adjoining
property. On -site December 31, 2019, to investigate complaint and observe facility operations. Alfred Kyne, Jr.,
Owner/Manager, and Jake Kyne, Operator/Manager, were on -site during the inspection.
2. Per the YWN-11-037 Facility Renewal form submitted on 5/31/19, the facility notified the Section it would accept
land clearing debris: including stumps, whole trees, tree limbs, branches, and untreated wood.
3. Site access is located off U.S. Highway 70 and Mimidis Lane in Swannanoa, NC.
4. The facility operational area appeared to be less than 2 acres in size.
5. As discussed during this inspection, continue to ensure that no more than 6,000 cubic yards of material are on -site at
any given time.
6. As discussed during this inspection, continue to maintain access around the processed and unprocessed materials at
the site for hot load and/or fire control. Since the previous inspection, facility personnel stated equipment had been
installed/maintained at the site for fire control. Additionally, a Fire Occurrence Notification form from the facility was
received by the Section on October 15, 2019, for a fire that occurred at the facility early on the morning of October 1,
2019. As discussed by telephone with the facility's Owner/Manager on October 1, 2019, and in multiple conversations
after the fire incident, continue to operate and maintain the facility to reduce the potential for fire/spontaneous
combustion to occur.
7. During this inspection, no unpermitted waste was observed in the unprocessed and processed materials on -site.
8. Continue to maintain all erosion control measures at the site as necessary.
