Dear Mr. Winegar:
In September 2018, the above -referenced facility sustained damage resulting from Hurricanes Florence and
Michael. The damage caused a release of the auto shredder residual (ASR) waste from the north side of the
landfill. Solid Waste Section (Section) staff accompanied OmniSource staff and inspected the site on October 5
and 12, 2018. After mutual discussion and evaluation of the situation, OmniSource submitted a schedule
covering the repair and restoration of the landfill to the Section for consideration. The Section approved this
schedule, a copy of which is included in the attached inspection report.
A partial inspection of the landfill was conducted by Section staff on March 19, 2019, with Jeff Hall present
representing OmniSource. Observations from the inspection are listed in the report accompanying this
correspondence. However, the inspection yielded the following major concerns about the present condition of
the facility:
• The sediment pond at the base of the northern slope of the landfill was found to be filled to capacity
with sediment.
• The slope leading down to the sediment basin continues to erode, where drain pipe has separated
and remains unrepaired.
• Sediment and leachate continue to flow from the sediment basin over the spillway and into the natural
environment north of the landfill.
• Although temporary erosion control measures on the northern slope of the landfill appear to have
been effective, ASR waste from the landfill remains on the slopes outside the landfill footprint,
exposed to the elements and moving with the natural flow of stormwater.
The approved schedule required a final repair design to be submitted to the Section for approval by November
9, 2018. It is now five months past the established submittal deadline and a final design has still not been
received by the Section. While the Section understands through communication with you, that Omnisource has
been working on moving this process forward, it seems Omnisource and/or your consultant fail to understand

and/or acknowledge the sense of urgency in remediating the issues at the facility as it pertains to facility
compliance under the NC General Statutes and Administrative Code. With normal spring precipitation alone,
the issues noted above and in the attached inspection report are placing Omnisource at a liability for additional
environmental impacts should a new release occur. The potential for a new release further increases with the
approach of the next hurricane season which begins in less than 60 days. OmniSource must take responsibility
for expediting the design and completion of the necessary repairs to the landfill. Failure to undertake
appropriate corrective measures in a timely manner to prevent further releases, will result in the Section
moving ahead with the tiered enforcement process.
