The Small Type I Facility currently operates under active Yard Waste Notification (YWN) #58-001. PURPOSE OF SITE VISIT: Comprehensive Site Inspection. STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Per the YWN-58-001 Facility Renewal form submitted on 5/29/19, the facility notified the Section it would accept land clearing debris, yard trash, and other: including stumps, whole trees, tree limbs, branches, untreated wood, leaves, brush/shrubs, and stone and asphalt millings. The site entrance is opposite of Fox Grape Hollow Road in Madison County, NC. 3. Site access roads were maintained during this inspection. 4. The facility operational area appeared to occupy less than 2-acres during this inspection (photo #1). Since the previous inspection, it appeared beneficial fill material (crushed asphalt) had been placed on -site to increase the pad depth of the operational area. 5. Post -inspection, on December 12, 2019, the Section contacted Mrs. Clara Ray, site owner/manager, to discuss facility operations. As discussed with Mrs. Ray post -inspection, since the site has not been utilized for some time, please ensure minimum buffer requirements are maintained for the facility. As discussed, a 50-foot buffer must be maintained between all property lines and compost areas, and a 50-foot buffer must be maintained between perennial streams and rivers and compost areas. To ensure maintenance of minimum buffer requirements at the site, the Section recommends the facility install and maintain buffer stakes/markers at the site. 6. During this inspection, processed materials were observed along the northern area of the site (photo #2). The processed materials were segregated by gabions/concrete barriers. As noted above in Additional Comment #5, please ensure a 50-foot buffer is maintained between the site and the Ballard property (parcel north of the site). 7. As discussed post -inspection, facility personnel stated the site is currently only used for the storage of processed materials and equipment and grinding of materials is not occurring at this time. During this inspection, some equipment was observed at the site. 8. During this inspection, no unpermitted waste was observed on -site. Continue to maintain waste screening efforts at the facility. 9. Continue to maintain all erosion control measures at the site as necessary. As discussed post -inspection, the Section recommends silt fence be installed at the toe (bottom) of the fill material along the western side of the site, adjacent to US 19 Highway. 10.
