I work with Rusty Norris at ELM Site Solutions. Rusty and I have been asked to help a client close out a residential property in Mecklenburg County so that he can sell the property. An environmental professional smelled petroleum earlier this year near the old heating oil UST on the property, but did not submit soil or groundwater samples for analysis. Although it is not confirmed, we are proceeding as if there is residual contamination, and we have emptied the remaining contents of the tank, plan to fill the tank, and we have abandoned the water supply well on the property (which was an unused well, as the property uses municipal water supply). We have also obtained a clean water sample from the neighboring property, which has the only well within 150 feet of the UST. I have read the details of the email you sent to Rusty Norris in July explaining regulatory steps for obtaining Low Risk status and an NFA letter, but I wanted to speak with you to be sure I understand exactly what applies in our situation. Below is my understanding of the requirements for us: In order to obtain a No Further Action determination from the DEQ, the property needs to be reclassified as Low Risk by: 1. Abandoning the well, obtaining a clean water sample from the neighboring well (done) a. The tank will also be filled Filing a Notice of Residual Petroleum (NRP) with the Register of Deeds in Mecklenberg County (NCGS 14313-279.9 and 14313-279.11).
