OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee(s) shall be
considered to have accepted the conditions of the permit and shall comply with the conditions of the permit. "
General Permit Condition Number 20(a) of Permit to operate 3608-Transfer-1993 states: "The tippingfloor and
loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily. "
During the inspection of the tipping floor waste was observed deposited on the deflector plates located at the edge of
one of two trailer loading bays. Facility staff stated this section of deflector plates and loading bay had not been used
in a couple of days. Waste was also observed in this loading area deposited on the I -beams in the trailer loading bay.

Waste Management of Carolinas is in violation of 15A NCAC 13B .0203(d) in that the tipping floor and loading
area was not maintained in a clean, sanitary condition at all times and was not cleaned at least daily.
2. 15A NCAC 13B .0402(1) states: "Operational plans shall be approved and followed as specified for the facility. "
The approved Facility Operations Plan Waste Management of Carolinas, Inc. dated May 12, 2016 (DIN 25637,
Page 4) "Housekeeping & Vector Control' states: "The operator is responsible for the operations, maintenance,
and general housekeeping of the facility. All extraneous solid waste will be swept and removed by broom and/or
shovel during the operations day. Any extremely wet material will be removed by washing the area down with water.
This wastewater will be routed to the sanitary sewer. "
During the inspection of the tipping floor waste was observed deposited on the deflector plates located at the edge of
one of two trailer loading bays. Facility staff stated this section of deflector plates and loading bay had not been used
in a couple of days. Waste was also observed in this loading area deposited on the I -beams in the trailer loading bay.
Waste Management of Carolinas is in violation of 15A NCAC 13B .0402(1) in that daily housekeeping is not
being performed. To achieve compliance, Waste Management of Carolinas must immediately remove the
waste on the deflectors and I -beams on a daily basis and perform daily housekeeping per the approved facility
operations plan.

General Permit Condition Number 21(a) of Permit to operate 3608-Transfer-1993 states: "The leachate control
system, such as floor drains, leachate collection devices, sanitary sewer connections and leachate storage tanks, must
be operational duringfacility operations. "
During the inspection of the active loading bay, there was excessive debris in the trench drain which appeared to be
clogging the drain. Leachate with floating debris was observed standing in the open trenches in the loading bay.
Waste Management of Carolinas is in violation of 15A NCAC 13B .0203(d) in that the floor drains were not
operational during facility operations. To achieve compliance, Waste Management of Carolinas must
immediately maintain the floor drains in operational condition during facility operations.

4. 15A NCAC 13B .0203(d) states: "By receiving solid waste at a permitted facility, the permittee(s) shall be
considered to have accepted the conditions of the permit and shall comply with the conditions of the permit. "
General Permit Condition Number 20 (e) (h) of Permit to Operate 3608-Transfer-1993 states: "Control
measures must be utilized to minimize and eliminate visible dust emissions and blowing liter. Windblown
materials must be collected by the end of the day and no windblown material may be allowed to leave the facility
boundary.
During the inspection waste and windblown material was observed under and around the tarping scaffolding.
Waste Management of Carolinas is in violation of 15A NCAC 13B .0203(d) in that windblown material is
not being controlled and collected by the end of each day. To achieve compliance, Waste Management of
Carolina must collect all windblown material before the end of each operating day.
5. 15A NCAC 13B .0402(1) states: "Operational plans shall be approved and followed as specified for the
facility ".
The approved Facility Operations Plan Waste Management of Carolina, Inc., dated May 12, 2016 (DIN
25637, Page 4) states: "Windblown litter is controlled at the transfer station by using covered transfer and
collection vehicles, confining waste transfer activities to the inside of the building, and controlling vehicle access
to the transfer building. Litter that escapes the transfer building will be picked up daily and managed to minimize
contact with stormwater ".
During the inspection waste and windblown material was observed under and around the tarping scaffolding.
Waste Management of Carolinas is in violation of 15A NCAC 13B .0402(1) in that liter that escaped the
transfer trailers was not picked up daily and managed to minimize contact with stormwater. To achieve
compliance, Waste Management of Carolina must collect all windblown material before the end of each
operating day.

6. 15A NCAC 13B .0203(d) states: "By receiving solid waste at a permitted facility, the permittee(s) shall be
considered to have accepted the conditions of the permit and shall comply with the conditions of the permit. "
General Permit Condition Number 19 of Permit to Operate 3608-Transfer-1993 states: "The permittee must
develop, and use, a training and screening program at the facility for detecting and preventing unauthorized
wastes from being accepted at the facility. At a minimum, the program must include:
a. Random inspections of incoming loads or other comparable procedures.
b. Records of all inspections.
Training of personnel to recognize hazardous, liquids and other excluded waste types ".
When waste screening records were requested, the facility stated the forms are submitted to CEI for record
keeping. Upon further inquiries by Steven Edwards waste screening records from January to August 2019 were
located. All waste screening records from September to the date of this inspection were missing. Facility staff
stated in a phone conversation that all waste screening records after inspection on 11-12-19 are now being stored
in the scale house.
Waste Management of Carolinas is in violation of 15A NCAC 13B .0203(d) in that they did not perform the
required number of random waste screenings and maintain required records of same. To achieve
compliance, Waste Management of Carolinas must immediately begin to perform the required number of
random waste screenings and maintain required records of same.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The facility is owned by Waste Management of Carolinas and operated by Custom Ecology Inc. (CEI).
2. The required signage is posted at the entrance of the facility to prevent unauthorized access.
3. The facility is secured by an automatic gate at the entrance of the facility.
4. The facility is permitted to receive solid waste from Cabarrus, Cleveland, Gaston, Iredell, Lincoln, Mecklenburg
and Union Counties.
5. Waste can be transported for final disposal to the Palmetto Landfill, Spartanburg, SC; Richland County Landfill,
Elgin, SC or BFI-Charlotte Motor Speedway Landfill V, Cabarrus County, NC. Currently all waste is transported to
Richland County Landfill, Elgin, SC.
6. The facility is currently accepting approximately 140 tons per day.
7. The facility was actively accepting waste during the inspection.
8. The trench drain along the entrance to the tipping floor was free of debris and is cleaned daily by facility staff. The
drain holes were clear of residue and facility staff stated they clean the trench drain at the end of each day to ensure
it is functioning properly.
9. Objectionable odors were detected at the entrance of the active loading bay. The odor increased and was strongest
around the underground oil -water separator located on the NW side of the transfer station. Leachate and a milky
substance was observed on the surrounding ground around the underground oil -water separator. Facility staff opened
the lids of the two manholes and leachate was observed and at the level of the rims of both manholes. Given that the
trenches in the building were full and the tank outside was full, indicating that the system was at maximum
capacity, it is highly likely that leachate was released in the area of the manhole covers. Within 10 days contact
Ervin Lane, Compliance Hydrogeologist, to determine the requirements for a soil sampling plan in order to
determine if leachate was released. Further actions to remediate leachate releases may be required based on

the laboratory analysis results.

10. Facility staff proved the following dates of when the oil water separator system was pumped (9/23/19, 10/22/19,
11/13/19).
11. The current permit and operations plan are maintained in the scale house and were reviewed with facility staff.
12. Other than the tarping area (see Observed Violations Section), the facility grounds were well maintained and free of
debris.
13. Holes were observed along the bottom of the outside wall of the trailer loading bay area. Repairs need to be
made to ensure leachate and waste do not escape the building.

14. During the inspection several areas were observed where the roof was leaking. The roof needs to be repaired to
maintain the facility and to prevent additional liquid on the tipping floor creating more leachate.

15. No leaking trucks were observed in the trailer staging area. Facility staff continue to stage trailers with the
open/doored ends facing up -gradient and lateral cross -door chains on all trailers to ratchet the doors tightly together
so that potential leakage will be minimized. Troughs are also placed underneath the back end of all trailers as a
protective measure.
