STATUS OF PAST NOTED VIOLATIONS:
15A NCAC 13B .0566 OPERATIONAL REQ. FOR LAND CLEAING/INERT DEBRIS (LCID) LANDFILLS
Land Clearing and Inert Debris (LCID) landfills shall meet the following operational requirements:
RESOLVED: (2) The facility shall only accept those solid wastes which it is permitted to receive.
UNRESOLVED: (4) Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size,
whichever comes first.
Jay K Riggs is in violation of 15A NCAC 13B .0566 (4) in that an area of the LCID landfill greater than one acre
in size was uncovered. Progress has been made towards covering the south and east slopes. However, the north
slope remains completely without cover. See comment section below for corrective action.
UNRESOLVED: (12) Open burning of solid waste is prohibited.

Jay K. Riggs is in violation of 15A NCAC 13B .0566 (12) in that fire and smoke were observed in several areas of
the LCID landfill and large areas of exposed waste were charred from previous burning. See comment section
below for corrective action.
OBSERVED VIOLATIONS:
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
On November 19, 2019, Davy Conners, Amanda Freeman and David Powell with NC DEQ Solid Waste Section re-
inspected Riggs Trucking LCID Landfill. The inspection was a follow up to the July 18 and June 6 inspections. Mr.
Jay Riggs was at the site; however, he had a respiratory infection, so he did not join us for the inspection. Mrs. Conners
spoke with Mr. Riggs before the inspection and after to review the findings.
In addition to the violations listed above, the following compliance issues were noted in the June 6, 2019 Inspection
Report. The status of those compliance issues is as follows:
1. UNRESOLVED: Immediate efforts shall be undertaken to extinguish any remaining areas of burning or
smoldering debris. The LCID landfill was smoldering and smoking in several locations during the November
19, 2019 inspection. Efforts must continuously be made to prevent and extinguish fires and smoldering debris.
2. UNRESOLVED: Any uncovered land clearing and inert debris waste material shall be covered within 30
days of receipt of this report. Efforts should be undertaken to reduce the near vertical slope of the active area
of the landfill to a slope that can be covered in accordance with the rules.
3. UNRESOLVED: Woody vegetation was observed growing on the side slope of the inactive area of the
LCID landfill adjacent to the powerlines. In addition, the slopes of the landfill appear to be steeper than
3:1. Side slopes of the landfill shall be mowed, removing any wooded vegetative growth such as trees, etc. If
needed to meet the 3:1 slope requirement in .0566, then re -grading and re -seeding of those areas shall be
considered necessary.
4. UNRESOLVED: Per 15A NCAC 13B .0564 (10), "The facility shall meet all requirements of any
applicable zoning ordinance." Section records note that the facility was attempting to resolve zoning approval
for this landfill, however we have no records of that final decision. Please provide a copy to this office.
5. UNRESOLVED: Electric power poles are located adjacent to the base of the landfill at the right -side slope.
The power company has an easement that runs along the right side of the landfill. It is suggested that the
landowners obtain written acknowledgement from the power company regarding the proximity of the electric
power poles to the landfill side slope, etc.
6. RESOLVED: All unacceptable waste material shall be collected and removed to a landfill permitted to receive
said wastes for proper disposal within 15 days of receipt of this report. During the inspection, unacceptable
waste was being separated as required. However, there was a small amount of painted block in the area
Mr. Riggs referred to as the dam that must be removed.
7. RESOLVED: No edge -of -waste markers were observed. Easily visible, permanent, edge of waste markers
delineating the LCID landfill area shall be installed within 30 days of receipt of this report.
8. RESOLVED: Per 15A NCAC 13B .0566 (8), "The facility shall be adequately secured by means of gates,
chains, berms, fences, etc. to prevent unauthorized access except when an operator is on duty. An attendant

shall be on duty at all times while the landfill is open for public use to assure compliance with operational
requirements and to prevent acceptance of unauthorized wastes." Ensure that the facility is either secured when
not in operation or staff is present when in operation.
In addition to the above previously noted compliance issues, the following were observed during the November 19,
2019 inspection and require action to address:
9. An erosion rill had formed at the base of the south slope. Adequate erosion control measures, structures, or
devices must be utilized to prevent silt from leaving the site and to prevent excessive on site erosion.
10. Surface water was observed ponding on the top of the LCID landfill. Surface water must be diverted from
the working face and shall not be impounded over waste. Properly covering and sloping the landfill will
promote positive drainage.
11. Drilling mud slurry was being disposed of next to the LCID landfill. You must ensure that you have met all
local, state and federal rules and regulations to accept them material. Final disposal of the material must be in
the LCID or used as cover and you must have data showing that the material is acceptable for this use. Duke
should be able to provide you with that data and testing results.
Because you are making progress towards resolving the above compliance issues and violations, the Section
grants you an additional 60 days to comply with the rules and regulations. I will reinspect the facility in
February, 2020.
