The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

1. At the Harris Trucking Mine there are two notified LCID landfills, N1089 (2 acre closed site) and N1104 (1
acre still active site). The two notified sites are on separate parcels and meet all buffer requirements.
2. Harris Trucking is in the process of actively pursuing a full LCID permit from the Solid Waste Section at this
site.
3. The purpose of the site visit was for Division Engineer to meet with Harris trucking staff and consulting
Engineer to discuss permit application and provide technical assistance.
4. During the meeting, apiece of painted block and apiece of plastic pipe was found in N1089. Pipe was removed
while onsite. Be sure and check loads for unacceptable waste. 15A NCAC 13B .0101 (22) -"Land clearing
and inert debris landfill" means a facility for the land disposal of land clearing waste, concrete, brick,
concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood, and yard trash.
5. Some edge of waste markers were viewed while onsite. Be sure these markers and new ones are visible and
maintained.
6. Side slopes shall be maintained at no steeper than a 3 to 1 ratio.
7. Per 15A NCAC 13B .0566 (3) Solid waste shall be restricted to the smallest area feasible and compacted as
densely as practical into cells.
8. Some waste was uncovered but facility staff is actively working to cover slopes and working faces with soil cover
on N1104. Per 15A NCAC 13B .0566 (4) Adequate soil cover shall be applied monthly, or when the active
area reaches one acre in size, whichever occurs first.
9. Be sure it is at least 1 foot per 15A NCAC 18.0566 (5) -120 calendar days after completion of any phase of
disposal operations, or upon revocation of a permit, the disposal area shall be covered with a minimum of
one foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. The Division
may require further action in order to correct any condition which is or may become injurious to the
public health, or a nuisance to the community.
10. Seeding and erosion control is needed to establish vegetative cover sufficient to restrain erosion. 15A NCAC 13B
.0566 (6) Adequate erosion control measures, structures, or devices shall be utilized to prevent silt from
leaving the site and to prevent excessive on -site erosion.
11. Vegetative cover on the N1089 is required. Suggest a cold weather mixture until warm season grasses can be
planted for long-term erosion control around April next year.
12. Notifying local government entities of the LCID in regards to the permit application was discussed.
13. Discussed concrete staging and using as beneficial fill. Must remove 75% of what is processed annually Per GS
13A-290.05.
14. An updated "Sediment and Erosion Control Plan" must be submitted to the Division of Energy, Mineral and
Land Resources to include the LCID and submit copy to Division of Waste Management.

permitted LCID disposal area.
Looking Northeast, on top of closed 2 acre LCID N1089 unit, at the east side of the 1-acre active LCID N1104
unit and area to be used for future permitted LCID disposal area. The side slopes have been eroded by storm
water; the gullies must be regraded and polished prior to using for landfill cell.

of closed LCID had been eroded by storm water; the gullies must be regraded and vegetative for the closed
landfill cover. The silt -up basin must be restored.
