The Land Clearing and Inert Debris (LCID) Landfill is OPEN. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On November 20, 2019, Chuck Kirchner met with Kenneth Phillippie to conduct a comprehensive inspection of the Phillippie LCID Landfill on Kimesville Road in Burlington, Alamance County. 1. The Phillippie land clearing and inert debris (LCID) Landfill – Kimesville Road is a notified land clearing and inert debris (LCID) landfill. 2. The Phillippie LCID landfill – Kimesville Road is owned and operated by Kenneth Phillippie. 3. The LCID landfill entrance is located off Kimesville Road, across from Boyd Wright Road. 4. Mr. Phillippie stores machinery and supplies for his grading company and, in the future, may build his residence on the lot. The property is ~ 21 acres in size. Additional land across Kimesville Road may be purchased in the future. 5. Mulch and compost are brought on site for re-sale. 6. Logs are removed from incoming land clearing debris (LCD) and stored separately for firewood or sale to a lumbermill. 7. Inert materials (concrete, brick, rock, gravel, uncontaminated soil, and used asphalt) are stored for use on site and by Mr. Phillippie’s grading and hauling company. 8. Storage areas and other operations conducted on the property should be setback from the LCID landfill. It is suggested that a 50-foot buffer area be maintained. The current access road around the property works well to maintain this buffer. It is recommended that this access road be kept in place. 9. Per 15A NCAC 13B .0564(9)(b), “The facility shall meet the following buffer requirements: 100 feet from the disposal area to property lines, residential dwellings, commercial or public buildings, and wells.” 10. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 11. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 12. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed. No erosion was observed on site. 13. The landfill appears to be less than 2 acres in size based the observations made during the inspection and a review of aerial imagery available online. 14. Mr. Phillippie inquired about what was required to convert this Notified LCID into a permitted LCID in the future and about a Large Type I Compost permit. Mr. Phillippie also inquired about what was required to have a disaster debris site at this location. 15. Please note that a permit must be obtained prior to LCID Landfill going over two acres in size. 16. LCID boundary markers were observed on site. 19. No water was observed ponding on the LCID Landfill. Continue to ensure that all water sheet flows away from the landfill and does not pond over LCID waste. 20. Open burning of solid waste is prohibited. 21. The site is secured by a metal chain and lock. 23. The facility has a proper sign. It is suggested that the facility number [N1079] is also posted.
