ADDITIONAL COMMENTS
On November 7, 2019, Chuck Kirchner met with Rod Jones with Orange County Solid Waste to conduct a partial inspection of the Orange County Regional MSW Landfill - Household Hazardous Waste Facility on Eubanks Road
in Chapel Hill, Orange County.
1. The facility is a permanent household hazardous waste (HHW) collection facility located adjacent to the Inactive/closed South Landfill Unit owned by Orange County. 2. The County operates two other active, permitted, and permanent HHW collection centers. One is located on Walnut Grove Church Road in Cedar Grove, NC and holds Permit No. 68-05. The second facility is located on Eubanks Road in Chapel Hill, NC and holds Permit No. 68-06.
3. Orange County has been in contact with the SWS - Permitting Branch regarding closure activities occurring after permit expiration. A closure permit will be issued upon receipt of additional documentation for the south MSW landfill.
4. The closure permit application for 68-01 is still under review. The ‘Post-Closure Land Use Operations Plan’ submitted requested an approval to use the 68-01 HHW area as an over-flow HHW waste storage area for the 68-05 and 68-06 facilities. This plan is not approved at this time.
5. This HHW facility (68-01) is no longer an active HHW drop off facility. 6. This facility ceased accepting HHW in late August 2018. 7. The County proposes to designate this facility as storage area for paints and household hazardous wastes for short periods of time. HHW material will be stored in this facility in the event that the County’s two HHW Collection Facilities are unable to store materials. An example of this might be during the Spring/Winter
Holiday periods when residents in the County are cleaning their homes i.e. “Spring Cleaning.” HHW will also be stored in this facility during any event that causes delays in regular transport. For example, following a severe weather event which may impede safe travel for transport and disposal. 8. This submitted plan states this facility will not be used as a permanent collection facility and that the County will remove any excess/emergency amounts of HHW as soon as reasonably possible not to exceed 30 days.
9. Currently only fluorescent bulbs are stored on site in the main HHW building and in one of the adjacent storage sheds. 10. Contact Ming-Tai Chow with Solid Waste Permitting to continue to use this facility while Permit is under review. 11. Any HHW accepted must be accounted for on a Facility Annual Report.
12. A second shed contains recyclable plastic bags. 13. Ensure any liquids stored on site have adequate double containment as needed. 14. The Chapel Hill Fire Department and/or the New Hope Volunteer Fire Department can be contacted to
address an emergency at the facility. 15. Only Orange County Solid Waste staff are on site during operation.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
