OBSERVED VIOLATIONS:
A. RESOLVED:I5A NCAC 13B .0203(d) states, `By receiving solid waste at a permitted facility, the permittee(s)
shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the
permit." Permit to Operate 4507-TP-, Attachment 3 Conditions of Operating Permit, #2 states "The T&P
mulching operation is approved to receive stumps, untreated and unpainted wood, and land clearing debris. Yard
trash is not acceptable at the site."
During the November 19, 2019 inspection, several loads of leaves were observed in the unground stockpile. A
large amount of leaves was noted on the north and south ends of the stockpile. Leaves are considered yard trash
and cannot be accepted at the facility.
On November 20, 2019, Riverside Stump Dump sent pictures showing that the leaves had been removed
from the unground stockpile. The leaves were taken to Riverside Stump Dump, Inc. IV (YWN-11-034) for

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on November 19, 2019 unless otherwise noted.
2. The facility is approved to receive stumps, untreated and unpainted wood, and land clearing debris.
3. The facility is secured by gates to prevent unauthorized access. Signage with the permit number, prohibited
material and emergency contact information was observed at the entrance to the facility.
4. The roads throughout the facility were in good condition and were constructed of all-weather material.
5. Adequate roadways were being maintained around all stockpiles to provide vehicular access in the event of an
emergency.
6. The unground and ground stockpiles were more than 50 feet from the property line. Boundary markers
delineating the 50-foot setback were installed on the north and west side of the facility. Some of the offset
makers near the entrance have been hit by equipment and need to be reinstalled properly.
7. Measures were being taken to divert storm water from the operational area and no standing water was observed.
8. Pallets were observed to be stored in a separate stockpile and no painted pallets were noted.
9. Several truckloads of leaves were observed on the north and south ends of the unground stockpile. Leaves are
considered yard trash and cannot be accepted at the facility. The leaves in the stockpile must be removed and
taken to a facility is permitted to receive yard trash.
10. The facility has a roll -off dumpster located to the west of the office to dispose of any unacceptable material that

is received at the facility.
