STATUS OF PERMIT:
A Permit Approval to Operate A Scrap Tire Collection and Processing Facility was issued to Ben Bryant and New
River Tire Recycling, LLC on February 4, 2019. The permit shall expire at the close of business December 20, 2024.

OBSERVED VIOLATIONS:
None Observed
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The facility consists of a Scrap Tire Collection and Processing Facility for the collection and processing of scrap
tires.
2. A copy of the Permit to Operate was current and available upon request.
3. Records detailing the amount of scrap tires received and processed by the facility were submitted by electronic
correspondence on November 18, 2019. Records showed that the facility had not exceeded its permissible storage
limit 1300-tons (130,000 tires based on 100 tires per ton).
4. Mr. Bryant explained that the site was inspected by the County Fire Marshal on 6/6/19.
5. The facility is permitted to receive tires from all states within the United States.
6. The facility had proper signage.
7. Gates were provided at both entrances to the facility to prevent unauthorized access.
8. A chain-length-fence is provided around the entire perimeter of the facility to prevent unauthorized access.
9. Phone service is maintained at the facility to assure contact with local fire protection authorities in case of fire.
10. No standing water was observed within the areas designated for storage of processed material or those areas
designated for receipt of tires.
11. A small amount of standing water was observed within the processing which was generated by machinery
designated for tire grinding.
12. An Emergency Preparedness Manual is provided under Appendix L of the approved facility application.
13. The indoor processing area and maintenance/storage areas were protected by an overhead sprinkler system and fire
extinguishers.
14. No tires or demolition material associated with demolition of the building roof were observed outside the footprint
of the concrete floor of the facility.
15. All scrap tire storage areas were greater that 50-feet from all property lines.
16. It appeared that scrap tire piles were within the permissible size limit of 5,000-square feet or 50,000-cubic yards.
17. Please ensure that a 50-foot fire lane is maintained around the perimeter of scrap tire piles. During the inspection,
a pile of scrap tires with rims did not have a 50-foot fire lane around the entire perimeter of the pile. However, it
appeared that a proper fire lane was provided around remaining scrap tire piles where required.
18. Please ensure that all stockpiles of processed material are maintained under 1,000-cubic yards as detailed in the
approved permit application for the facility. During the inspection, two stockpiles of rough shred with soil mixed
in were observed to be greater than 1,000-cubic yards. Mr. Bryant and Mr. Cagle stated that both piles would be
ground soon into tire derived fuel (TDF). Ensure that any soil or waste screened from the rough shred material is
properly disposed.
19. A small pile of demolition debris measuring approximately 20’ X 15’ consisting primarily of broken concrete
(painted and unpainted), brick painted wood and metal, was observed at the southwest corner of the building.
Please ensure that this material is removed for disposal within 30-days of issuance of this inspection report at a
solid waste facility permitted by the Division to prevent a violation of 15A NCAC 13B .0104(f).
20. Catch filters were in place within all storm drains on the south side of the facility to prevent residuals from
depositing into the storm drain system.
