The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On October 31, 2019 Chuck Kirchner conducted a comprehensive inspection of the C.L. Summers & Son LCID Landfill on Wagoner Road in Gibsonville, Guilford County.
1. The C.L. Summers and Son Landfill is a notified land clearing and inert debris (LCID) landfill. 2. The landfill is known as Summers LCID Landfill, Inc.
3. The LCID landfill footprint still appears to be inside the two-acre limit. A permit is required prior to landfill being expanded to larger than two acres. 4. The LCID landfill appears to be primarily used by Clarence L. Summers and Son Trucking and
Grading, Inc. but was previously noted to be open to the general public. 5. The LCID landfill is operated by Clarence Summers, Jr.
6. Removed logs from land clearing debris (LCD) are still stored separately to cut for firewood. 7. Reusable concrete items are stored along the access road. 8. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and
compacted as densely as practical into cells.” 9. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.”
10. Adequate soil for cover was observed on site. 11. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed.
12. It has been stated that the older portion of the landfill contains only soil and that the side slopes, of the soil area, contain inert materials for stabilization. 13. The facility has an all-weather access road.
14. The facility has a proper sign. It is suggested that the facility identification number is posted: N0550.
15. The facility is also a temporary disaster debris staging site (TDDSS). The TDDSS number is: DS41-005. It is suggested that the identification number is posted. Please contact me if you have any questions or concerns regarding this inspection report.
