Pursuant to 15A NCAC 13B .0201(g), no later than November 16, 2021, the permittee must submit a request to the Section for permit review and must update pertinent facility plans. PURPOSE OF SITE VISIT: Compliance inspection and missing Facility Annual Report STATUS OF PAST NOTED VIOLATIONS: N/a OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 1 of 2 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA D° nnn°ta`°"'�� '°"""' Solid Waste Section ADDITIONAL COMMENTS This facility is permitted to receive coffee and tea grounds, restaurant pre -and post -consumer food waste, organic material (mulched leaves, yard waste and mushroom substrate) and manure with bedding. The following observations were made during the October 22, 2019 inspection. 1. Vermiculture composting is being contained in eight modified 55-gallon barrels with one additional barrel used for demonstrations. Ten barrels total are allowed by the permit. 2. No sign was present at the entrance of the facility. According to the permit, a sign must be maintained at the site entrance providing site information including the permit number, prohibited materials, and emergency contact information. However, this facility is not open to the public and signage is limited by Durham City Ordinance as noted in your permit application. Please see *Note below for more information. 3. Temperature and moisture levels were being taken however records of temperature and moisture were not being kept. The permit specifies that compost process data must be maintained in writing as required to document temperatures, moisture levels, and turning/aeration intervals. Please see *Note below for more information. 4. An annual report for 2018/2019 had not been submitted. An annual report of facility activities for the fiscal year July 1 to June 30 must be submitted to the Section by August 1 of each year on forms provided by the Section. This report must include the amount of materials composted in tons, temperature records, and metal, pathogen, and foreign matter testing analytical data. 5. Storage of pre-processed debris and mulch was in piles smaller than the maximum 30 feet in height, 50 feet in width, with unlimited length within the approved boundaries. 6. Testing for metals had not been done this year. All compost produced at the facility must meet the requirements of Rule .1407 of the Solid Waste Compost Facilities Rules and the approved operations plans. 7. Copies of this permit, the approved plans, and all records were maintained at the facility and made available to the Section upon request. *Note: Effective November 1, 2019 this facility might qualify to be conditionally exempt from needing a permit, according to the new rules. You should receive information about these rules within the next few months. Testing for metals is still necessary if the facility distributes product to the public.
