Box 8 Bolivia, NC 28422 SUBJECT: Notice to Cease Operations Compliance Inspection Report S & B Maintenance LLC SLAS-10-21 Brunswick County Dear Mrs. Mary Cook: On July 10, 2019, the State of North Carolina, Division of Waste Management’s Solid Waste Section (Section) issued a Notice of Continued Violation letter to Mrs. Mary Cook of S & B Maintenance LLC regarding observed violations associated with your Septage Land Application Site (SLAS-10-21). The Section conducted a follow-up inspection of the site (SLAS-10-21) on October 18, 2019. Due to the fact that the violations cited in the Notice of Continued Violation letter dated July 10, 2019 have not been corrected at this time, you are hereby notified that the Section intends to move forward in the enforcement process. According to 15A NCAC 13B .0842 (a)(18) that states “land application sites or portions of land application sites that do not follow the approved nutrient management plan shall not be used for land application until brought into compliance with the nutrient management plan,” the 3.3-acre site listed in the SLAS-10-21 permit can no longer be used for the land application of septage. If the land application site is used before being brought into compliance, this may generate further violations. In addition, your current firm permit (NCS-00298) renewal application and your current Septage Detention & Treatment Facility permit (SDTF-10-18) rely on the use of the above mentioned septage land application site (SLAS-10-21) for proper disposal. Given this condition, the Section cannot issue to you a valid firm permit, nor can the tanks listed in the SDTF-10-18 permit be North Carolina Department of Environmental Quality | Division of Waste Management 217 West Jones Street | 1646 Mail Service Center | Raleigh, North Carolina 27699-1646 919.707.8200 S & B Maintenance LLC Notice of Continuing Violation Page 2 of 2 October 30, 2019 utilized until such time the compliance issues have been remedied at the septage land application site (SLAS-10-21) to the satisfaction of the state. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. We solicit your cooperation and would like to avoid taking further enforcement actions. At the same time, it is your responsibility to comply with the requirements of the General Statutes and/or the North Carolina Administrative Code.
