ADDITIONAL COMMENTS; 1 - The land on which this landfill is located is owned by H.D. Newbern and Finley S. Newbern and recorded in Book 401 page 46 of the Currituck Co. Register of Deeds. 2 - The Notification was recorded on July 24th, 1997 in Book 413 Page 825 of the Currituck County Register of Deeds. 3 - Noted in the last inspection conducted on August 27, 2019. Need to replace gate and signage that was also missing. Both of these items are required. 4 - The road is in good condition. Constructed of rock and sand for limited all-weather conditions. 5 - Not grinding material currently. Adequate cover is being added. 6 - Mr. Newbern was asked to put up edge of waste markers as to being able to ensure no solid waste is outside of the site footprint (less than 2 acres) of this Notified site. If waste is outside of the edge of waste markers, grade to become in compliance or an Individual Permit would be required. Markers have been installed, John College will measure the footprint in the near future to ensure compliance. 7 - Facility has been taking Land Clearing debris to an old pond on this tract of land and filling the pond area instead of to the Notified site. This is a violation. A notice of Violation will be sent to this facility for all violations listed. 8 - Items listed were discussed with H.D. Newbern and Finley Newbern at this facility. 9 - Digital pictures were taken during this Facility Compliance Inspection.

Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
