STATUS OF PAST NOTED VIOLATIONS:
RESOLVED: 15A NCAC 02C .0108(k) states: "All non -water supply wells, including temporary wells, shall
be secured with a locking well cap to ensure against unauthorized access and use." The Town of Kernersville
was cited for failure to secure all landfill gas and groundwater monitoring wells against unauthorized access and
use. In an email dated August 14, 2019, Laura Elliott, Project Geologist, Withers Ravenel, certified that all
monitoring wells had been fitted with locks. An inspection of the hinges on MW-5 and MW-6 found that the
required repairs had been completed and the hinges were functioning properly. Both MW-5 and MW-6 were
observed to be properly secured. MW-4 was also inspected and found to be properly secured. Ms. Elliott
explained that the well pipe on MW-4 had been shortened so that the well cap could be closed and locked.
Therefore, this violation is considered to be resolved.
2. RESOLVED: 15A NCAC 02C .0108(1) states: "All non -water supply wells shall be equipped with a steel outer
well casing or flush -mount cover, set in concrete, and other measures sufficient to protect the well from damage
by normal site activities. The Town of Kernersville was cited for failure to equip all landfill gas and groundwater

monitoring wells with a steel outer casing set in concrete. In an email dated August 14, 2019, Laura Elliott,
Project Geologist, Withers Ravenel, certified that steel casings set in concrete pads had been installed around all
landfill gas monitoring wells. MW-1 and MW-5 were inspected, and both steel casings were observed to be
properly installed and set in concrete, as required. In addition, the tree and root ball that had damaged MW-5 had
been removed so that no further damage to the well would occur. GW-6 and GW-7 were also inspected and steel
casings set in concrete appeared to have been installed properly on both wells. Therefore, this violation is
considered to be resolved.
OBSERVED VIOLATIONS:
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. Several of the new passive landfill gas vents were observed and found to be in good condition. Ms. Elliott stated
that the new passive vent in the vicinity of MW-1 and GW-1 had so far not been effective at reducing the
exceedances that had been showing up during the monitoring events. She explained that additional work would
be done to try to pinpoint the cause of the problem and design a solution.
2. The remaining landfill gas and groundwater monitoring wells that had been cited for deficiencies in
construction were inspected and found to be in compliance with construction standards. (See the Status of Past
Noted Violations section of this report for additional information.)
3. The landfill slopes appeared to be in good condition and the cap had a well -established vegetative cover.
