Application for renewal should be done no later than January 15, 2020. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: Per 15A NCAC 13B .0566 (4) States: “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” Attachment 3, Section 17, of the LCID permit No. 71A-LCID states, “Solid waste must be covered with 1 foot of suitable soil cover at least once per month or when the active area reaches 1 acre in size, whichever occurs first, or more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown materials, vectors or excessive water infiltration.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 NCAC 13B .0566 (5) States: “120 calendar days after completion of any phase of disposal operations, or upon revocation of a permit, the disposal area shall be covered with a minimum of one foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. The Division may require further action in order to correct any condition which is or may become injurious to the public health, or a nuisance to the community.” Be sure that any waste, placed or exposed, is covered with one foot of suitable soil within thirty days of receipt or when the exposed waste area reaches one acre in size. This includes side slopes. During inspection on September 26, 2019 there were many areas of waste exposed and uncovered. There is not enough adequate soil to cover the open and active disposal areas currently. This needs to be addressed immediately before any further disposal of waste or opening new areas. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” Per 15A NCAC 13B .0566(2), “The facility shall only accept those solid wastes which it is permitted to receive.” In addition, the active area is much bigger than 1 acre and beyond the ability of current staff and equipment abilities to manage and cover. Treated lumber and plastic were noted during inspection and need to be removed and properly disposed of. All area open should be covered properly, edge of waste marked and the site should maintain an “active” waste accepting area of 1 acre or less so that proper management and compliance is maintained. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 6 Per Attachment 3, Section 12, of the LCID permit No. 71A-LCID states, “the facility must maintain a supply of cover material adequate to cover the working face in case of an emergency or fire, at all times. There was not sufficient cover onsite to cover all the active areas/phases of waste onsite. Per Attachment 3, Section 11, of the LCID permit No. 71A-LCID states, “Durable, permanent markers that accurately delineate the waste disposal boundary and are easily visible must be installed and maintained.” These need to be fixed at all locations waste is currently.” Edge-of-waste markers were missing at many locations. Permanent waste boundary markers need to be installed within 30 days and maintained around the entire landfill to include active and inactive areas. Waste marker frequency should be placed so that you can see from one to the other. Per Attachment 3, Section 12, of the LCID permit No. 71A-LCID states, “Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical feet (3:1).” Side slopes on several areas were greater than a 3:1 slope. These areas need additional cover which should be this can hopefully be corrected during that process. Per NCAC 13B .0566 (11) States: “Solid waste shall not be disposed of in water.” Waste was found in standing water along the edge of buffer near the roadway. Please remove and correct the slope there so storm water can be managed without erosion. Be careful not to cause any water quality violations with runoff. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 6 ADDITIONAL COMMENTS 1. The facility is a land clearing and inert debris (LCID) landfill. 2. The facility has proper signage. 3. The Permit to Operate Expires July 15, 2020. Application for renewal should be done no later than January 15, 2020. 4. The facility is properly secured with a locked gate. Personnel are on site during operating hours. 5. The facility is permitted to receive waste generated within Pender, New Hanover, and Brunswick Counties. 6. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and asphalt. This facility is permitted to receive land clearing waste; yard trash, trees, stumps, and brush; untreated and unpainted wood; uncontaminated soil, rock, and gravel; and inert debris such as unpainted brick, concrete, and concrete block all in accordance with NCGS 130-294(m). 7. The facility site plan, operations plan, and permit are kept on site and were reviewed with the site owner/operator at this inspection. 8. Access roads are of all-weather construction. 9. When correcting the slope issue and adding cover, be sure not to encroach onto the required buffers. 10. Facility stockpiles concrete onsite for future use. Per G.S. 130A-309.5 (c) (1) Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 6 11. The facility must be operated in accordance with the approved operations plan and permit. Changes or modifications to the design or operations of the facility including storage areas must be submitted to the permitting branch for approval before making changes. An updated map will be required to show changes. 12. Liz Patterson and David Powell revisited site on October 4, 2019 due to Tommy Batson with Pender County Emergency Management contacting NCDEQ, Solid Waste Section regarding fire at Running Deer Landfill. Paper copy of Solid Waste Management Facility Fire Occurrence Notification Form was provided and reviewed with Clyde Wisecarver onsite. 13. As of 6:15 on Friday, October 4, 2019 fire was mostly out. Contractor onsite digging it out with big and small excavators. Contractor said he is going to dig up the pile and move it back away from the surrounding Wetland. We spoke with the owner and the contractor about using this time to move the material out of the buffer with enough room to cover once done. Contractor plans to work until Sunday. We also brought up with the working crew and owner to take notice of adding water and it leaving is leachate into the wetlands. 14. John Drish with Utilies Specialist Co. shared follow-up pictures from site on Saturday afternoon with Liz Patterson as crews continued monitoring for hot spots and properly covering waste. 15. Due to fire occurring at the landfill on Sunday, October 4, 2019 Facility Operator needs to provide oral notification to the Section within 24 hours of the occurrence followed by a written report of the details of the fire within 10 working days of the occurrence. Please review and comply with facility permit ATTACHMENT 3, CONDITIONS OF OPERATING PERMIT 13. Open burning of land clearing waste is prohibited. If a fire occurs, the permittee must provide oral notification to the Section within 24 hours of the occurrence followed by a written report of the details of the fire within 10 working days of the occurrence. The report must include the cause, the location(s) on the premises, the dimensions and volume of material involved, a description of emergency response activities with results, and a description of mitigation measures implemented to reduce or eliminate conditions leading to the fire. Other conditions may be required based on the severity or nature of the fire. 16. NCDEQ, Solid Waste Section has been notified of previous fire incident at facility by Pender County Emergency Management. 17. Digital pictures were taken during the inspection. 18. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 45 days receipt of this report. The SWS will conduct a follow-up inspection in 45 days to ensure issues noted in this inspection are have being addressed. If significant progress is not made, then further compliance actions may be taken by the Division.
