OBSERVED VIOLATIONS:
1) A pumper vehicle with tag number JB5878 was observed on 08/28/19 lettered as Elite Waste Services
(EWS) by a Division of Waste Management inspector. The pumper vehicles inspected today also did
not have all required lettering or the lettering was not three (3) inches or greater in height. The
lettering issue is a violation of Rule .0835 (b) that states “All permitted septage management firms
shall display lettering on each side of every pumper vehicle operated by the firm. The lettering shall
include the firm name, town name, phone number, and septage management firm permit number
as shown on the firm application. All lettering required by this Rule on the pumper vehicle shall be
no less than three inches in height and legible, distinguishable from the background, and not
obstructed from view…” The lettering on the vehicles needs to be corrected to meet Rule .0835(b).
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

2) A Division of Waste Management staff observed a pumper vehicle with tag number JB5878 on 08/28/19
lettered as Elite Waste Services (EWS). Elite Waste Services had changed its name to Wall Recycling, LLC.
I called Wall Recycling, LLC on 08/29/19 about the pumper vehicle not being properly lettered. Vehicle
was taken off the road. Schedule an inspection today of all the vehicles because of the vehicle not
properly lettered and the firm name change from Elite Waste Services to Wall Recycling, LLC.
3) The required lettering and height of three (3) inches was not present on all pumper vehicles. Jeff
emailed pictures of the trucks to me on 09/13/19 and 09/18/19 to show the updated lettering. See
pictures below.
4) The tanks on all five (5) trucks were made of metal and permanently affixed to the frames of the trucks.
5) Access ports appeared to be in working order and properly sealed.
6) Valve appeared to be in working order. Caps present on the hose ports.
7) No leaks noticed.
