This is a violation of Rule .0842(a)(7) that states “Septage shall be applied to the surface of the land from a moving vehicle in a such a manner as to have no standing liquid or soil disturbance resulting from the waste flow after the discharge is complete.” Any remaining septage ponding needs to be incorporated into the permitted fields or vacuumed up. 2) Area of dead vegetation covered with a coating of grease septage was observed in ST-2 application fields. Crop damage that occurs from applications is a violation of Rule .0842(a)(14) that states “Grease septage shall be diluted at least 1:1 from its concentration when pumped with domestic septage or water if land applied over perennial vegetation. This dilution shall be increased if crop damage occurs…” Any remaining septage needs to be incorporated and then a cover crop established within 30 days. In ST-1 field near SDTF-71-08 at corner ST-1 field beside road separating fields SEE ADDITIONAL PAGE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The ponding of septage in both Fields ST-1 and ST-2 is a violation of Rule .0842(a)(7) stated in Observed violations.
