Follow up inspection
STATUS OF PAST NOTED VIOLATIONS:
A. RESOLVED: 15A NCAC 13B .0566(4): cited for failure to apply adequate soil cover monthly, or when the active
area reaches one acre in size, whichever occurs first. Facility staff have applied adequate soil to the landfill side
slopes that were observed to have inadequate (no) soil on July 7, 2019 and July 11, 2019. Therefore, this violation
is considered resolved.
B. RESOLVED: 15A NCAC 13B .0566(2): cited for failure to remove all unacceptable waste from the waste stream
and disposing at a permitted facility. Railroad ties and silt fence material were observed in a pit area to be buried on
August 16, 2019. Facility staff provided a copy of the disposal ticket for the railroad ties and silt fence that were
disposed of at Gaston County Landfill on August 26, 2019. Therefore, this violation is considered resolved.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The site looked clean and well maintained. The access roadway is of all-weather construction. No signs of erosion
were observed on the tipping area or roadway.
2. The landfill appears to be compacted and adequately covered. (See STATUS OF PAST NOTED VIOLATIONS
section above for additional information.)
3. Please ensure all unacceptable waste is removed before landfilling and properly disposed of at a facility
permitted to receive it.
4. Contact David Giachini, P.E., Permit Engineer, to determine the requirements for a full permit to expand the landfill
over two (2) acres.
