HomeMy WebLinkAboutNCS01399_Closure_20190610 August 13, 2019 Mr. Michael Zaffuto Roto-Rooter 44 Buck Shoals Rd H5 Arden, NC 28704 Re: Ceased Operation as a Septage Management Firm Roto-Rooter NCS-01399 Dear Mr. Zaffuto: On June 10, 2019, The Division of Waste Management, Solid Waste Section, received correspondence from you indicating that Roto-Rooter NCS permit # 01399, will not be renewing its Septage Management Firm Permit for 2019 and is ceasing operations as a septage management firm. Effective August 13, 2019, your records will be removed from our active list of septage management firms. If at any time you wish to continue operation as a Septage Management Firm, you will need to apply for a new permit in accordance with the septage management rules prior to starting to operate. Please note that you may not legally operate a septage management firm in North Carolina without a permit. General Statutes, GS 130A-291.1 (c) No septage management firm shall commence or continue operation that does not have a permit issued by the Department. The permit shall be issued only when the septage management firm satisfies all of the requirements of the rules adopted by the Commission. General Statutes, GS 130A-291.1 (c) Commission. A septage management firm that commences operation without first having obtained a permit shall cease to operate until the firm obtains a permit under this section. You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations.
