The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
Proper lettering License tag
1 – Inspected pump truck: VIN – 12-11-2123: NC tag AZ-77345 2 – Waste tank volume is 10,000 gallons 3 – Pumper vehicle was properly lettered with company name, city, phone number, and permit number in letters larger than three inches on both sides of the truck 4 – Tank made of steel and appears constructed to prevent leaks and spills 5 – Valves and access ports appeared in proper working order. Caps were present on access ports 6 – No evidence of leakage from the tank, valves or access ports
7 – New truck being put into service
8 – As this is a 10,000 gallons septage truck be sure to follow 15A NCAC 13B .0835 (a)(6) that states “tanks that are mounted on trailers for the pumping or transportation of septage shall meet all applicable State and federal requirements for highway use.”
9 – If this vehicle is to be used for storage follow 15A NCAC 13B .0835 (f) that states “Vehicles used in the transportation of septage, that are listed on an approved septage management firm permit application, may remain loaded or partially loaded on land owned by the septage management firm for up to seven days without obtaining a permit for a detention or treatment facility. Such vehicles shall comply with this Rule.”
