Gentlemen:
The Solid waste Section (SWS) completes a review of the permit application for the new landfill facility –Johnny Harris Trucking LCID # 1 and have several comments below. Please provide written responses tothe comments and requested additional information & approval documents from the third party which mustbe incorporated into the revise permit application. Additionally, the permit application forms that sent toyour attentions on last Friday; the SWS today sent an invoice of permit fee to you as well. Please completethe forms and pay the fee as requested by law so the permit processes/issuance won’t be delayed.
1. (Section 2) Where is the new landfill physically located? Please provide the facility address. 2. (Section 2) As described in the Section, the new facility will combine two existing landfill units. Please describe the each of the two existing units including the info below, but not limited to:i. The permit number of each notification LCIDLF unit.ii. The acreages of the disposal area of each unit. The locations and waste boundaries (inacreage) must show on the drawing Sheet No. C01.iii. The in-place waste volume (in cubic yard) of each landfill unit. The in-place wasteboundaries (lateral and vertical) should be added to drawings Sheet Nos C05 through C08. 3. (Section 2) This Section states that the proposed landfill facility is part of reclamation project ofpermitted mining project. Please provide the mining permit issued by the NC Division of Energy,Mineral and Land Resources. To do so, the facility siting requirements stated in Rule 15A NCAC13B .0564(2) through (5) can be considered as “completed.” (Section 3/ Exhibit 3.5) Please provide the following info:
4. i. Survey coordinates and ground elevation for each of three soil borings.ii. Since Exhibit 3.5 only concluded the “seasonal high-water table (SHWT)” at each of thethree soil borings, how the data was used, interpreted, and concluded the SHWT for the 15-acre site to satisfy the requirements stated in Rule 15A NCAC 13B .0564(8)? Pleaseelaborate the processes to determine the proposed landfill base grades shown on drawingsSheet Nos. C05 through C08.
5. (Section 4/Exhibit 4.1-Operation Plan) Please provide additional info or address the concerns below:i. (Item 3)a. According to Google Map, the proposed landfill unit will be adjacent to the location ataddress 310 Rubicon Road. Two haul rods can lead waste-loaded vehicles into the roadleading to the landfill. Please show the security measures/deices (gate and fence) andsignage described in Item 3 will be located on the drawing.b. The facility is opened to the public use of waste disposal. According to NCGS. 130A-309.25, a responsible individual certified in waste operations must be on-site during alloperating hours of the facility at all times while open for public use. Please add thisrequirement to Item 3. ii. (Item 5) According to NC Session Law 2015-286 and NCGS 130A-310.68 -77, the earthenmaterial has contaminants with concentrations, concluded by approved analytical tests,below the “Residential Preliminary Soil Remediation Goals (PSRG)” can be used/applied onland without any restriction. The PSRG can be found in the following web link, pleaseappend the document to the Operation Plan for waste screening/acceptance reference. It isthe permit hold’s responsibility to ensure that accept “uncontaminated soil” for disposal atthe landfill unit will not cause any damage to the environment and human health.Please add the reference next to the Please define the “uncontaminated soil.”https://files.nc.gov/ncdeq/Waste%20Management/DWM/SF/IHS/PSRGs_May2019_FINAL.pdf. iii. (Item 6) Please detail the proposed waste screening including, at a minimum, the screeningfrequency, the training/credential of the inspector, record of keeping for the waste screening,and verbally reporting of unauthorized dumping to the Division of Waste Managementwithin 24 hours after the incidence occurred. iv. (Item 12) Please address the long-term stormwater and soil erosion/sediment control for siteconstruction and operations:a. The landfill is a perpetually disposal repository which will be closed out by soil coversystem and constantly subject to soil erosion; therefore, all BMPs for soil erosion andsediment control can’t not be temporarily functional (as stated in Item 19). At least one ortwo permanent sediment basins must be constructed and maintained throughout the entireservice life of the proposed landfill. The BMPs and sediment basins that must be locatedinside the landfill property but outside the disposal boundaries shall be a portion of theErosion and Sediment Control Plan (ESCP) which must be approved by NC Land QualitySection. The approval document (ESCP) including drawings (C04 & C09), and thepermit must be a portion of the landfill permit application.b. Seven skimmer basins are proposed to be constructed at the landfill facility, but there areno perimeter drainage structures – ditches, swales, or channels to safely conveystormwater to any nearby surface water bodies or drainage features. If they are wetponds, how to eliminate the ponds to become breeding grounds of mosquitoes. How thewater inside the basins to be discharged if the surface water generated from an extremestorm event exceeds the design capacity of the skimmer basins. Please clarify.c. The top/deck portion of the proposed final cover of the landfill is not sloped forfacilitating drain. Since settlement of in-place wastes shall occur for the entire life of alandfill, the sufficient slopes of the landfill final cover must be constructed to prevent anysurface water from ponding on the landfill cover. Please also revised the drawings C03through C08 accordingly. v. (Item 14) Please address the concerns of fire preventions and reporting requirements:a. A functional fire extinguisher should be equipped inside each vehicle, machinery, and/orequipment.b. Please provide a copy of a letter issued by the local fire department that the departmenthas been notified by the permit applicant and will assist in fighting a fire, if occurs.c. Please add the report of a fire requirement to this Item 14 - If a fire occurs, the permitteemust provide verbal notification to the Section within 24 hours of the occurrence followed by a
written report of the details of the fire within 10 working days of the occurrence. (Section 5) Please provide a copy of the approved permit of the Erosion and Sediment Control Planfor the landfill construction and operations. The copy of the permit should be appended to the permitapplication. (also see Comment No. 7).
7. (Drawings)i. The drawing Sheet C01 shall be properly scaled to show the contents (nearby RubiconRoad/Partridge Lane and residential buildings & water bodies/impoundments), to satisfy therequirement stated in Rule 15A NCAC 13B .0565(2)(b) &(3)(k).ii. To avoid confusion, please add the waste disposal area is 8.03 acres to all drawings. Callout/note the waste boundaries on the drawings.

Gentlemen: Today, the Solid waste Section (SWS) received the permit application for the new LCID Facility – JohnnyHarris Trucking LCID #1 in Carthage, NC. Since it is a new facility, I am attaching the application formsfor you to complete so that the following permit review processes can continue. Based on the data filled in the forms, the SWS will invoice the permit applicant one time permit fee; theinvoice will sent to you with the correct e-mail address on the form. Then, the rule-required compliancehistory review forms will be sent to you to completed. The completeness of your permit application will bedetermined within 90 days (by November 30, 2019) per NCGS 130A-295.8. Please work with me to get the paperwork straight so if all things play out as they should be, the permitapproval to construct and operate may be issued to your landfill within 90 days.
