OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0105(c)(4) states: "The vehicle or container body, waste holding area, and hopper, if so
equipped, shall be free of holes, cracks, rusting, corrosion, or other evidence of damage or weakness that may
allow the escape of solid, semi -solid, or liquid waste."
Jackson County is in violation of 15A NCAC 13B .0105(c)(4) for failing to ensure that waste transport
trailers are maintained in a leak -resistant condition, free of holes cracks, rusting, corrosion, or other
evidence of damage or weakness that may allow the escape of solid, semi -solid, or liquid waste.

During the September 10, 2019 inspection, trailer #9 was loaded and parked in the loaded trailer parking area.
Holes were observed on the rear passenger sidewall near the tailgate of the trailer. Construction and demolition
waste observed protruding out the holes in the trailer.
To correct the violation Jackson County must immediately:
1. Remove trailer #9 from service until repairs can be made.
2. Repair the holes in the sidewall of trailer #9 to ensure that it can meet the requirements of 15A NCAC 13B
.0105
3. Implement procedures to inspect each trailer before loading to ensure that all trailers can meet the
requirements of 15A NCAC 13B .0105.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on September 10, 2019.
Operations Inspection of the Transfer Station (5003T-TRANSFER-)
2. Facility staff move empty trailers into the loading bay, load the trailers and then move the full trailers to the
loaded trailer parking area.
3. Three loaded trailers were parked under cover on a concrete pad with leachate collection. No leachate was
observed leaking from any of the trailers; however, the rear passenger side of trailer #9 has been pierced,
creating holes that could allow waste to escape. No leachate was observed leaking from trailer #9. 15A NCAC
13B. 0105(c)(4) states: "The vehicle or container body, waste holding area, and hopper, ifso equipped, shall
be free of holes, cracks, rusting, corrosion, or other evidence of damage or weakness that may allow the escape
of solid, semi -solid, or liquid waste.' Trailer #9 shall be taken out of service until repairs can be made to
ensure that it can meet the requirements of 15A NCAC 13B .0105. Please see Observed Violations
Section of this report.
4. The trench drains in the loading bay were observed to be clear and appeared to be working properly.
5. Minimal material was observed in the loading bay and facility staff stated that it is cleaned daily.
6. The trench drains at the entrance to the tipping floor were observed to be clear and appeared to be working
properly.
7. The tipping floor was in good condition and no unapproved material was observed.
8. Windblown litter was minimal and was well managed at the time of inspection.
Operations Inspection of the Recycling Area
9. The facility uses the former transfer building to collect cardboard and mixed paper for recycling.
10. Bottles and cans are collected in a transfer trailer to the south of the fiber building.
11. The fiber and containers that are collected are sent to Curbside Management in Asheville, NC for processing.
Other Comments
12. The facility collects empty, triple rinsed, dry pesticide containers in a shipping container located to the southeast
of the scale house.
13. Scrap tires are collected in two van trailers and are sent to US Tire in Concord, NC for processing.
