STATUS OF PAST NOTED VIOLATIONS:
A. CORRECTIVE ACTIONS IN PROGRESS: 15A NCAC 13B .1626(8)(d) Transylvania County was cited for
allowing leachate to leave the lined disposal cell or leachate collection and storage system. Sampling was
conducted and results were sent to the section for review. Additional measures may be required pending review
of laboratory results.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on September 4, 2019.
2. The facility is currently filling in Phase 5 of the landfill.
3. Minimal windblown litter was observed and was well managed at the time of inspection.
4. The top of the landfill had ample soil cover and the facility has minimized the movement of equipment across
the top the cell which has resulted in minimal waste being tracked across Phase 5.
5. The working face was small and compact. Two pallets were observed in a load that was dumped during the
inspection. Facility staff saw the banned material and removed them from the working face. Please continue to
remove banned materials that are encountered and manage them as required by law.
6. The side slopes in Phase 5 had good soil cover and no erosion issues were observed. No leachate issues were
noted during the inspection. The area where leachate releases occurred during the spring of 2019 have been
regraded and seeded.
7. The facility is working on addressing erosion issues in Phases 1-3. The facility was actively hauling additional
soil to Phase 3 of the landfill during the inspection. Facility staff stated that they were planning to continue
repairing erosion issues and seeding the side slopes of Phases 1 and 4.
8. The facility is conducting a voluntary lead assessment investigation on the top of Phase 3 in the inactive portion
of the landfill. More than 30 Geoprobe samples were taken and the holes were backfilled with bentonite. The
facility is awaiting laboratory analysis from the samples.
