The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The February 1, 2017, PTO renewal approved the continued operation of the facility's Large Type I composting and
wood waste treatment and processing operations.
2. The facility is approved to accept land clearing debris, yard trash, and clean, untreated, and unpainted wood waste.
3. During this inspection, temperature monitoring data records from July 6, 2018, through August 26, 2019, were
reviewed. All temperature monitoring data records appeared to be in compliance with the Type 1 material management
requirements and no issues were noted.
4. Site access was controlled, site signage was maintained (photos #1 & #2), and access roads (photo #3) were adequate
at the facility during this inspection.
5. Dust control measures appeared to be sufficient at the facility during this inspection.
6. All pre-processed waste, windrows, and final product piles (photo 94) appeared to be appropriately sized with adequate
fire breaks and lanes. Continue to maintain access around all material piles at the facility for fire control as necessary.
7. As discussed during this inspection, it appeared the facility has maintained an excellent job of waste screening at the
facility. No unpermitted waste was observed during this inspection. A roll -off container is available at the facility to
receive any unacceptable materials. Continue to segregate and dispose of all unpermitted waste received at the facility
as necessary.
8. As discussed during this inspection, continue to maintain all sediment basins and other erosion control measures at
the facility as necessary.
9. All buffers and setbacks appeared to be maintained at the facility during this inspection. (Note: Buncombe County
government regulates activities in the flood plain adjacent to this site. A development permit for this facility has been
issued by Buncombe County (Permit Application renewal DIN #25988) to allow for storage of commercial mulch along
the floodplain fringe. Per Buncombe County Zoning Ordinance, this parcel is in an EMP zoning district and this
facility's operations are considered an existing non -conforming use. Existing non -conforming uses do not require
special approval in order to continue operations (letter dated December 29, 2016, Permit Application renewal DIN
#25988).
10. As observed during this inspection, NCDOT construction activity for Interstate 26 has progressed along the southern
and eastern sides of the facility property since the last inspection.
11. Overall, the facility appeared to be well operated and maintained.
12. This facility is also designated as a Temporary Disaster Debris Staging Site (DS #11-006) in Buncombe County.
