The Solid Waste Section disagrees with the statement that the expansion does not meet the definition of a "new facility." In accordance with .1603 13B .1603 (a) (1) (B), the expansion is a new facility because it will "expand the MSWLF unit boundary approved in accordance with subparagraph (a)(1) of Rule .1618." Rule .1618 (a)(1) refers to the site suitability previously approved. The site suitability previously approved did not include the expansion area now proposed as part of the waste boundary. A Site Suitability application is needed for the lateral expansion. Parts of the previous site suitability application may be used again, and that documentation will need to be submitted with the expansion application submittal. However, some of the siting criteria will have to be updated, for criteria that can change over time, for example, distance to airports, distance to residences, streams, wells, etc. It is noted that the Phase 5 PTC application included an updated wetlands study and endangered species study. For the wetlands study, provide the US Army Corps of Engineers response to the wetlands study and request for jurisdictional determination. For the endangered species study, a letter from the NC Department of Cultural Resources is needed that concurs with the findings of the onsite endangered species study, dated August 2016, that the proposed landfill expansion will not jeopardize the continued existence of endangered or threatened species or result in the destruction or adverse modification of a critical habitat, protected under the Federal Endangered Species Act of 1973. The following are the requirements of a Site Study. Local government approval 2. Facility plan, conceptual plan with drawings 3. Regional characterization study 4. Local characterization study 5. Site hydrogeologic report (Perry Sugg is the contact for this part of the submittal) 6. Location restrictions 7. Traffic study. A letter must be submitted from the NC Division Engineer, Department of Transportation, that states that, the proposed facility will not have a substantial impact on highway traffic, in accordance with NCGS 130A-295.5 (a) and (b). 8. SEPA, in accordance with 130A-295.6 (a) The site suitability application is a separate document from the Permit to Construct application for Phase 5. The site suitability will have to be approved before the Permit to Construct application can proceed. If you have questions or comments, please let me know.
