Graham County Lee Hill, NCDEQ — Solid Waste Section STATUS OF PERMIT: Permit to Construct (PTC) issued August 22, 2003 Permit to Operate (PTO) issued April 24, 2015 Operations Plan (DIN 24115) approved April 7, 2015 Permit expires October 12, 2020 PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: A. 15A NCAC 13B .0105(c)(4) states: "The vehicle or container body, waste holding area, and hopper, if so equipped, shall be free of holes, cracks, rusting, corrosion, or other evidence of damage or weakness that may allow the escape of solid, semi -solid, or liquid waste." Graham County is in violation of 15A NCAC 13B .0105(c)(4) for failing to ensure that waste transport trailers are maintained in a leak -resistant condition, free of holes cracks, rusting, corrosion, or other evidence of damage or weakness that may allow the escape of solid, semi -solid, or liquid waste. Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA o"' t0E­!�'m"" lW'Ift Solid Waste Section During the August 29, 2019 inspection, trailer 03 which was parked in the loading bay and actively being loaded was observed with four holes in the right (passenger) sidewall of the transfer trailer. Trailer 02 was observed actively leaking leachate from the rear door and from a crack in floor of the trailer. B. 15A NCAC 13B .0105(c)(6) states: "The vehicle or container shall be loaded, transported, operated, and maintained to prevent the escape of solid, semi -solid, or liquid waste to the environment." Graham County is in violation of 15A NCAC 13B .0105(c)(6) for failing to ensure that waste transport trailers are loaded, transported, operated and maintained to prevent the escape of solid, semi -solid, or liquid waste. During the August 29, 2019 inspection, trailer 02 was observed to be loaded and parked to the east of the transfer station and outside the leachate collection system. Trailer 02 was observed actively leaking leachate from the rear door and a crack in floor of the trailer. To correct the violations Graham County must immediately: 1. Repair the holes in the sidewall of trailer 03 to ensure that it can meet the requirements of 15A NCAC 13B .0105(c)(4). 2. Repair the crack in floor of trailer 02 to ensure that it can meet the requirements of 15A NCAC 13B .0105(c)(4) and 15A NCAC 13B .0105(c)(6). 3. Remove trailer 02 and 03 from service until repairs can be made to ensure they can meet the requirements of 15A NCAC 13B .0105. 4. Implement procedures to inspect each trailer before loading to ensure that all trailers can meet the requirements of 15A NCAC 13B .0105. 5. Capture any leachate leaving loaded trailers and prevent it from entering the environment. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on August 29, 2019. 2. Waste is transported by Graham County to the Pine Bluff Landfill in Ballground, Georgia for disposal. Operations Inspection of the Transfer Station (3803-TRANSFER-) 3. Windblown litter was minimal and well managed at the time of inspection. 4. The trench drains at the entrance to the tipping floor were observed to be clear and appeared to be functioning properly. 5. The push walls were in good condition and no waste was observed on top of them. 6. No unapproved material was observed on the tipping floor at the time of inspection. 7. The facility was loading trailer 03 during the inspection. Four holes were observed on the right (passenger) side of the trailer approximately 12"-18" inches from the top of the trailer. Per 15A NCAC 13B .0105(c)(4) all trailers must be free of holes, cracks, rusting, corrosion, or other evidence of damage or weakness that may allow the escape of solid, semi -solid, or liquid waste. Trailer 03 must be taken out of service until the holes in the sidewall are repaired and the trailer can meet the requirements of 15A NCAC 13B .0105(c)(4). See Observed Violations section of this report. 8. The loading bay was observed to be clean and the trench drain appeared to be working properly. 9. Trailer 02 was loaded and parked to the east of the transfer station and outside the leachate collection system. Trailer 02 was observed actively leaking leachate from the rear door and from a crack in floor of the trailer. Trailer 02 must be taken out of service until the crack in floor is repaired and the trailer can meet the requirements of 15A NCAC 13B .0105. See Observed Violations section of this report.
