STATUS OF PAST NOTED VIOLATIONS:
A. CONTINUING VIOLATION: 15A North Carolina Administrative Code 13B .0566(4), cited for failure to
apply adequate soil cover monthly, or when the active area reaches one acre in size, whichever occurs first.
During the inspection conducted on July 7, 2019, landfill side slopes were observed to have inadequate (no) soil
cover. Cover requirements were discussed with Mr. Whitesides during that inspection along with the requirement
to apply cover to all burned debris from the open burning. During the inspection conducted on August 16, 2019,
landfill side slopes were observed to have inadequate soil cover and an area containing charred debris and ashes
from the opening burning observed on July 11, 2019 was observed to have no soil cover. Therefore, T&L Grading
continues to be in violation of 15A NCAC 13B .0566(4).
To achieve compliance T&L Grading must immediately apply adequate soil cover to the exposed land
clearing debris on the landfill side slope, including any charred land clearing debris.

B. RESOLVED: 15A North Carolina Administrative Code 13B .0566(12), cited for failure to follow the rule for
open burning. T&L Grading provided a letter dated August 6, 2019 stating as of July 27, 2019 the waste burning
in the fill area had been completely extinguished. During the inspection no debris was observed to be on fire.
Therefore, this violation is considered resolved.
C. RESOLVED: 15A North Carolina Administrative Code 13B .0566(16), cited for not providing the proper
signage at the entrance to the facility. T&L Grading provided a letter dated August 6, 2019 stating as of
August 6, 2019 a sign was posted at the facilities entrance naming Terry Whitesides as the emergency contact
along with contact number and permit number. Therefore, this violation is considered resolved.

OBSERVED VIOLATIONS:
A. 15A North Carolina Administrative Code 13B .0566(2) states: "The facility shall only accept those solid wastes
which it is permitted to receive. "
During the inspection unacceptable waste (silt fence material and railroad ties) was observed in a pit area to be
buried.
To achieve compliance all unacceptable waste must be removed and disposed at a permitted facility. Provide
copies of waste disposal tickets to Kim Sue, 610 E. Center Avenue, Suite 301, Mooresville, NC 28115.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. Waste boundary markers had been installed depicting the two -acre disposal area. It was reiterated to Mr.
Whitesides that the footprint of the landfill could not go beyond the two -area boundary area. In questioning Mr.
Whitesides about the final elevation for the top portion of the landfill, he stated he wanted the elevation to be the
same as the berm along the road. Mr. Whitesides stated he wanted to push the land clearing debris up to the
existing berm. It was discussed with Mr. Whitesides that no land clearing debris could go beyond the two -acre
boundary and that area in between would have to be filled in with soil.

3. Ensure no land clearing debris is disposed of in water per 15A NCAC 13B.0566(11).
