PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: Not applicable. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. This notified yard waste operation shares the site with a notified LCID landfill (N0600). The property is comprised of 46.19 acres and is owned by Newsome Grading Co., LLC. 2. The facility is open to Newsome Grading Co. trucks during normal working hours, and open to select customers by appointment. 3. The facility is secured by a gate that is kept locked when the landfill is closed. 4. At the time of both inspections, the facility was observed to be clean and well -maintained. 5. The access road is of all-weather construction and was found to be in good condition. 6. During the July 30, 2019 inspection, the site was dry, and all areas were accessible by vehicle. The August 22, 2019 site visit followed a night of severe thunderstorms, and most areas of the site were muddy. 7. The yard waste operations are located north of the landfill and include small stockpiles of mulch and topsoil, and a large tub grinder. Mr. Newsome stated that he uses the mulch and topsoil for his grading projects. 8. A review of the yard waste notification renewal submitted for 2019 indicated that 1300 cubic yards of material had been received at the facility and approximately 280 cubic yards of mulch had been removed. 9. No unacceptable materials were observed in the yard waste operations area. 10. The area appeared to be somewhat overgrown with grasses. However, no ponding water was observed, and the operations area was easily accessible. 11. The mulch stockpile appeared to be approximately 40' x 30' in size with an estimated height of 15' . Please reshape the mulch stockpile so that at least one fire land is incorporated to ensure adequate access for emergency equipment and personnel in case of fire. 12. A sediment basin is located between the landfill and borrow area. Mr. Newsome explained that he had been working with DEMLR staff to install several more sediment ponds on the property to ensure that he is able to control stormwater runoff as the landfill expands. 13. No unacceptable material was found in the yard waste operations area. Please contact me if you have any questions or concerns regarding this inspection report.
