The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS:
1. The facility is a notified LCID landfill that accepts primarily land clearing debris and used concrete from
Newsome Grading Co. job sites. The landfill is open to Newsome Grading Co. trucks during normal working
hours, and open to select customers by appointment.
2. The landfill is situated on a 46.19-acre parcel owned by Newsome Grading Co., LLC. Based on aerial
photography dated February 2019, the current size of the fill area is estimated at .75 acres.
3. The site also contains a small yard waste notification operation (YWN-29-001) that was inspected on August
22, 2019 as well. A report covering that inspection has also been filed.
4. The facility is secured by a gate that is kept locked when the landfill is closed.
5. At the time of both inspections, the facility was observed to be clean and well -maintained.
6. The access road is of all-weather construction and was found to be in good condition.
7. During the July 30, 2019 inspection, the site was dry, and all areas were accessible by vehicle. The August 22,
2019 site visit followed a night of severe thunderstorms, and areas surrounding the landfill unit were muddy.
However, the tipping area was found to be well compacted and stable.
8. The edge of the tipping area was observed to be lined with loads of land clearing debris ready to be pushed into
the landfill. Mr. Newsome stated that he allows the brush to sit there until he is ready to push the waste and
work on the landfill because it serves as a barrier to trucks that might otherwise venture too close to the edge.
9. A small stockpile of used asphalt was found to be staged on the northern side of the landfill. Mr. Newsome
stated that he uses the asphalt and concrete to maintain the access roadway and internal driveways.
10. Mr. Newsome pointed out a small pile of logs that had been stacked beside the tipping area. He stated that he
separates suitable logs and gives them away as firewood.
11. A borrow area is located behind and to the east of the landfill. Side slopes of the borrow area appeared to be
stable and well -maintained. No signs of erosion were evident.
12. Above and to the east of the borrow area is a stockpile of concrete. Mr. Newsome stated that he had not yet
accumulated a sufficient volume of concrete to enable him to hire a contractor to crush it.
13. A sediment basin is located between the landfill and borrow area. Mr. Newsome explained that he had been
working with DEMLR staff to install several more sediment ponds on the property to ensure that he is able to
control stormwater runoff as the landfill expands.
14. No unacceptable material was found in the concrete stockpile or in the landfill.
15. The side slopes of the landfill were nearly vertical in most spots, and the waste on the slopes was not covered at
the time of these two inspections. The requirement to cover all waste with clean soil at least monthly was
discussed, and Mr. Newsome stated that he would reshape the side slopes to achieve a 2:1 or 3:1 grade so that
he could compact and cover the waste as required. He also discussed the idea of reducing the size of the
working face to make it easier to fill one area and then compact and cover it before beginning to fill the next.
Ensure that all waste is adequately covered with clean soil at least monthly, as required by 15A NCAC
13B .0566(4). It is recommended that a cover log be established and maintained at the site. The log should
indicate the dates on which clean soil was applied to cover all waste in the landfill, and would also serve
to demonstrate the landfill's compliance with the monthly cover requirement.
