The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1- Facility is currently permitted for four 21,000 gallon frac tanks. Modification underway for dewatering process.
Majority of units (tanks, lines, pumps etc) are currently in place. Walked thru the facility, discussed the waste
process while reviewing the site drawings. Various changes were noted on site – need revised site drawings
(just the one page). Made minor tweaks to the SDTF application form. Reviewed/discussed the operation
manual. Various discrepancies/missing info were noted – need revised pages (a copy of the specific pages were
given to the operators). Reviewed various items that were submitted for the permit modification. Need the
discharge permit when it is issued by the City. Discussed that when the permit is issued and processing can
begin then the treatment log will need to be maintained, reviewed the required information and gave an example
log. Discussed when other firms are allowed into the facility in the future then an authorization form for each
firm shall be submitted to the Raleigh Central office.
2- The No Trespassing sign is posted at the site entrance. The above ground tanks appear structurally sound. The
required 5 foot cleared radius (free of excess vegetation or debris) is present around the facility. The approved
setbacks are being met. No leaks or spills were noted. No apparent vectors or odors.
3- No processing of waste shall occur until the new modified permit is issued. Only storage in the 4 frac tanks is
permitted at this time.
