RECAN Secretary MICHAEL SCOTT Director July 3, 2019 Sent via email: ed@jetenproperties.com Ed Tarantino Jeten Properties, LLC 8580 Highway 150 Terrell, NC 28682 NORTH CAROLINA Environmental Quality SUBJECT: Structural Fill Cap Maintenance Jeten Structural Fill Coal Combustion By -Products Structural Fill CCB0029 Catawba County Dear Mr. Tarantino: On June 19, 2019, Brandy Costner and Joanna Harbison, representing the Division of Water Resources (DWR), inspected property containing the closed Jeten Structural fill, CCB0029 off Highway 150 in Catawba County. Overall, the closed structural fill was being maintained in good condition, however, it was observed that recent mowing activities had disturbed/cut into the soil cap covering the fill on the hillside behind the business buildings located on site, exposing a very small amount of ash. Based on observations, no coal ash material had migrated off -site. It was communicated to you by DWR staff that the exposed areas would need to be recovered with soil in accordance with the rules. The specific rule is 15A NCAC 13B .1705, which states in part the following: (a) The structural fill facility must be designed, constructed, operated, closed, and maintained in such a manner as to minimize the potential for harmful release of constituents of coal combustion by-products to the environment or create a nuisance to the public. (j) All structural fills shall be covered with a minimum of 12 inches compacted earth, and an additional surface six inches of soil capable of supporting native plantgrowth. If you have not started this remedial action, please do so immediately as to meet the rule requirement above. Please keep this office updated on your progress as DEQ staff may conduct follow-up inspections to verify compliance.
