The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. LCID Landfill Notification N1066 was filed for recordation in the McDowell County Register of Deeds Office on
May 15, 2012 (Book CRP 1071, Pages 194-202). LCID Landfill N1066 is located on Parcel ID 063700282000 in
McDowell County.
2. Site inspection conducted by Mr. Kris Riddle, Section, on July 29, 2019. No one was observed on -site during the
inspection, although Mr. Riddle telephoned Mr. Craig earlier on this date to inquire about gate access to the site. Post -
inspection, Mr. Riddle also contacted Mr. Craig to discuss the site inspection.
3. Site access is controlled by a gate/electric fence and located off Cell Tower Road, via Mt. Hebron Road, in Old Fort,
NC. Site Signage was posted adjacent to Cell Tower Road and provided dumping and contact information (photo #1).
4. Site access roads were maintained during this inspection. As observed on -site and discussed with Mr. Craig post -
inspection, recent maintenance of access roads occurred at the site (photos #3 & #4). These maintenance efforts
appeared to allow for better access to the site operational area(s).
5. During this inspection, the site appeared to meet all minimum buffer requirements.
6. During this inspection, the facility disposal area appeared to be under 2 acres in size.
7. During this inspection, no unpermitted waste was observed on the working face or slopes of the LCID landfill (photo
#2). A small pile of segregated waste (plastic piping, metals, and 2 railroad ties) were observed on -site near the soil
borrow area. As discussed with Mr. Craig post -inspection, these materials had been removed from a recent load
delivered to the site and the Section was advised they would be disposed of properly. As discussed, continue all waste
screening efforts at the site.
8. Continue to ensure solid waste accepted at the facility is restricted to the smallest area feasible and compacted as
densely as practical into cells.
9. Soil cover appeared to be maintained at the site. Continue to ensure adequate soil cover is applied monthly or when
the active area reaches one acre in size, whichever occurs first.
10. Continue to maintain erosion control measures at the site including ditch lines, rip -rap channels, diversion berms,
and vegetative ground cover as necessary. During this inspection, erosion control measures appeared to have been
recently maintained. Erosion control maintenance efforts at the site were confirmed with Mr. Craig post -inspection.
11. During this inspection, surface water appeared to be diverted from the working face and not impounded over waste.
12. Per Mr. Craig's request, an informal meeting was held at the Asheville Regional Office on June 13, 2019. Mr.
Riddle and Mr. Craig discussed current site operations, viewed site satellite images (Google Earth), and discussed
potential future site expansion (while remaining less than 2 acres).
13. Temporary Disaster Debris Site DS-56-005 is also located on this parcel.
