PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 15A NCAC 13B .0105 COLLECTION AND TRANSPORTATION OF SOLID WASTE (2,3,4&7) 15A NCAC 13B .0402 OPERATIONAL REQUIREMENTS (1,6&7) FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 ADDITIONAL COMMENTS: 01 - This Facility has several Locking gates and fencing for security. 02 - Signage is posted and has required information. 03 - Roads are constructed off all-weather materials and are maintained. 04 - Facility is permitted to receive waste from Edgecombe, Nash, Halifax, Wilson, Martin and Pitt Counties. 05 - The Waste from this Transfer Station is permitted to be taken to The East Carolina Regional Landfill (08-03) and/or to Sampson County Disposal, LLC (82-02). 06 - This facility has 5 Certified Transfer Station Operations Specialist: Larry Moore: expires 05/25/22, Travis D. Hudson: expires 12/08/21, Dennis Cuffee, expires 05/31/22, Gloria A. Mosely: expires 10/20/20 and James Hucks, expires 05/25/22. 07 - The area behind the push walls on the tipping floor needs to be cleaned better. The tipping floor was clean. 08 - The Trailer load out bay needs to be cleaned better. Spill over waste piled up all over the sides. 09 - There was windblown trash under the cat walk, around the leachate tanks and the open top container that was under very high grass/weeds. If was evident that this trash has been there for some time due to the grass/weed height. This must be picked up by the END OF THE WORKING DAY, EVERYDAY THE FACILITY IS OPEN. 10 - There were 2 trailers leaking leachate onto the ground. No attempts were made to put containers under them. Trailers are in need of repair (#’s TT140 hole in front & TT132 the rear door was warped with waste packed in the seal area.) This must be addressed before a NOTICE OF VIOLATION is sent to EDGECOMBE COUNTY for this facility’s NON-COMPLIANCE. 11 - The white goods area, had some items standing upright and some laying down. No evidence the CFC had been removed. The was also 7 CFC containing products that had recently been pushed up onto the scrap metal pile with no evidence the CFC had been removed. 12 – The Yard Waste area is not being managed well. There were piles of new material scattered all over the place. Some were obstructing the road. This needs to be managed better. Keep in windrows. The problem is, there is NO ATTENDENT present to supervise this area or the WHITE GOODS area when off-loading occurs. 13 – CORRECTIVE ACTION IS NEEDED AT THIS FACILITY TO STAY IN COMPLIANCE. FOLLOW UP INSPECTIONS WILL BE CONDUCTED TO ENSURE ALL THE ABOVE ITEMS ARE ADDRESSED AND THE STAFF CONTINUES TO PREVENT FUTURE VIOLATIONS. 14 – DIGITAL PICTURES WERE TAKEN DURING THIS INSPECTION AND ALL ITEMS LISTED WERE DISCUSSED WITH MANAGEMENT AND FACILITY STAFF. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. (b) The solid waste collector shall transport to a site or facility only those solid wastes that are allowed by facility permit. (c) Vehicles or containers used for the collection of solid waste, and transportation by whatever means, including highway, rail, and navigable waterway, shall be constructed, operated, and maintained to be leak resistant in order to prevent the creation of a nuisance to public health from the escape of solid, semi-solid, or liquid waste. In order to meet the requirement to be leak resistant, the owner and/or operator of the vehicle or container shall adhere to the following standards: (1) All surfaces that come in contact with waste shall be smooth and non-absorbent. (2) All drain holes and valves shall be closed, plugged, or sealed. (3) The vehicle or container shall be equipped with seals, gaskets, or other devices pursuant to manufacturer specifications in order to prevent the escape of liquids. Such seals, gaskets, and other devices shall be maintained and replaced pursuant to manufacturer specifications. (4) The vehicle or container body, waste holding area, and hopper, if so equipped, shall be free of holes, cracks, rusting, corrosion, or other evidence of damage or weakness that may allow the escape of solid, semi-solid, or liquid waste. (5) The waste holding area, including the hopper and around the packer blade, if so equipped, shall be clean of debris to prevent vectors or the accumulation of litter. (6) The vehicle or container shall be loaded, transported, operated, and maintained to prevent the escape of solid, semi-solid, or liquid waste to the environment. (7) The vehicle or container shall be serviced, repaired, and cleaned to maintain sanitary conditions, to preserve the integrity of the door seal, to prevent the accumulation of mechanical fluids, dirt, and filth on the vehicle's exterior, and to prevent contamination of the environment by fluids. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 6 15A NCAC 13B .0402 OPERATIONAL REQUIREMENTS Any person who maintains or operates a transfer facility shall maintain and operate the facility in conformance with the following practices unless otherwise specified in the permit. (1) Operational plans shall be approved and followed as specified for the facility; (2) A facility shall only accept those wastes which it is permitted to receive; (3) Water that comes into contact with solid waste will be contained on-site or properly treated prior to discharge from the site. An NPDES permit may be required prior to discharge to surface waters; (4) Equipment for fire control shall be available; (5) Effective vector control measures shall be applied to control flies, rodents, and other insects or vermin; (6) Equipment shall be provided in the storage and charging areas and elsewhere as needed or as may be required in order to maintain the facility in a sanitary condition; and (7) Appropriate method shall be provided to confine material subject to be blown by the wind within the area. At the conclusion of each day of operation, all windblown material resulting from the operation shall be collected and returned to the area by the owner or operator.
