OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1626(8)(b) states: "Surface water shall not be impounded over or in waste."
Haywood County and Santek Environmental of North Carolina, LLC are in violation of 15A NCAC 13B
.1626(8)(b) for allowing water to be impounded over waste.
During the July 29, 2019 inspection, standing water was observed on the eastern side of the trailer tipper which
was located on the south side Phase 4 cell.

To achieve compliance, Haywood County and Santek Environmental of North Carolina, LLC must reshape
the area around the tipper or move the tipper to prevent water from ponding on top of the landfill cell and
to provide positive drainage.
Standing Water at Tipper
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on July 29, 2019.
Ouerations Inspection of the MSWLF Unit (4407-MSWLF-1993)
2. The facility starting filling operations in the newly constructed Phase 4 cell on January 16, 2019.
3. Minimal windblown litter was observed, and temporary employees were actively picking up litter at the time of
inspection.
4. Waste was observed around the tipper and appears the material may not be cleaned up at the end of each working
day. 15A NCAC 13B.1626(2)(a) states: "Except as provided in Sub -Item (b) of this Item, the owners or operators
of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each
operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter,
and scavenging." All solid waste, including waste on and around the tipper, must either be covered

with a minimum of six inches of soil or collected and returned to the working face at the end of
each operating day.
5. Standing water was observed on the eastern side of the tipper. 15A NCAC 13B .1626(8)(b) states, "Surface
water shall not be impounded over or in waste." Ensure the area around the tipper is reshaped to prevent
water from ponding on top of the landfill cell and to provide positive drainage. (See Observed Violations
section for additional information.)
6. Waste was being unloaded on the southern most side of the cell and was being pushed to the northern
end of the cell. Moving waste in this manner has resulted in a working face that was approximately one
acre in size or greater. All disposed solid waste must be covered with a minimum of six inches of
soil or approved alternative daily cover at the end of each operating day.
7. Waste mixed with previous days cover soil was windrowed on the eastern side of the working face.
Ensure that this material is returned to the working face at the end of the operating day and is
covered with a minimum of six inches of clean soil or approved alternative daily cover.
8. Good soil cover was noted on the top of the eastern side of Phase 4 cell.
9. Facility staff were actively repairing some erosion rills located on the northern slopes of Phase 3 at the
time of inspection. Facility staff stated that the side slopes of Phase 3 were scheduled to be over seeded
when weather conditions became favorable.
10. The leachate pond had adequate freeboard and the liner appeared to be in good condition.
11. Pre -operational inspections will be conducted to ensure that the facility is in compliance with 15A
NCAC 13B.1626(2)(a).
