Rowan County is in violation of 15A NCAC 13B .1626(2)(a) for failure to cover disposed solid waste with six inches of earthen material at the end of each operating day or more frequently, if needed to control nuisance, odor or vectors. During the inspection several areas of the active landfill were observed to have inadequate soil cover and erosion Page 1 of 7 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section issues. These areas were located adjacent to the working face and on the south side slope facing the working face. Rills have developed which had exposed waste. Exposed waste was also observed along the roadway approach to the working face. Rowan County was in violation of 13B .1626(2)(a) for failure to apply adequate soil cover to slopes and operational areas. Facility staff provided photographic documentation at the end of the working day on 7-19- 19 showing adequate soil was applied to exposed waste located adjacent to the working face, south side slope facing the working face, and the roadway approach to the working face. B. 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit. " Materials Mulching and Grinding Number 51 of Permit to Operate 8003-MSWLF-1988 Rowan County Landfill Phase IV states: "The facility is permitted to receive wooden pallets constructed of unpainted and untreated natural wood. " Rowan County is in violation of 15A NCAC 13B .0203(d) by accepting waste that the facility is not permitted to receive. During the inspection of the mulching and grinding (T&P area), several pallets with painted ends, pallets with plywood, pallets with stain, plastic shipping wrap and cloth like material were observed. Pallets with paint and stain were observed in contact with the ground. To achieve compliance, Rowan County must remove all unacceptable waste from the unprocessed wood waste stockpile and dispose of it at a properly permitted facility. Proof of proper disposal must be presented to the Solid Waste Section for verification. Please note that the MSW landfill may not receive wooden pallets, per GS 130A-309.10(f)(12). Facility staff provided photographic evidence on 7-31-19 documenting the pallets with painted ends, pallets with plywood, pallets with stain, plastic shipping wrap and cloth had been removed. Mr. Sinclair stated that usable pallets were taken to his recycling center for packaging materials, and the remainder of the pallets were picked up by Salvador Bautista to be refurbished for reuse at a local produce stand. Therefore, the violation is considered to be RESOLVED. C. 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit. " General Conditions Number 45 of Permit to Operate 8003-MSWLF-1988 Rowan County Landfill Phase IV states: "Surface water shall be diverted from all operational and storage areas to prevent standing water in Page 4 of 7 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section operational areas and under or around storage piles. Water that comes in contact with solid waste shall be contained on -site or properly treated prior to discharge. " Rowan County is in violation of 15A NCAC 13B .0203(d) by allowing water to pond under and around wood waste storage pile. During the inspection of the mulching and grinding (T&P) area, standing water was observed on the northwest side at the base of the unprocessed pallet pile. To achieve compliance, Rowan County must perform maintenance to the wood waste area to prevent future ponding of water under and around wood waste storage pile. Facility staff provided photographic evidence on 7-30-19 documenting that the area around the pallets had been regraded to prevent ponding, therefore the violation is considered to be RESOLVED. Page 5 of 7 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Proper signage was observed at the entrance of the facility. 2. The facility is permitted to receive solid waste generated within Rowan County and out of county waste within the State of North Carolina. The facility receives waste from Cabarrus County, Davidson County, Davie County, Iredell County, Gaston County, Forsyth County, Stanley County, Mecklenburg County, Guilford County, Wake County, and Rowan County. 3. The facility accepts an average of 350 tons per day. Operational Inspection of the MSW Landfill Unit: 4. The facility is currently working in Phase 4. 5. Edge of waste markers were observed. 6. Working face was small and compact. 7. The facility utilizes synthetic tarps as daily cover and soil once a week. 8. All access roads maintained in good condition. 9. Facility staff was actively hauling and applying dirt to the east side of the working face. 10. Facility staff was actively picking up windblown waste during the inspection. Mulching and Grinding (T&P area): 11. Material is ground twice a year. 12. Mulch is not distributed to the public. White Goods and Scrap Metal Collection Area: 13. Area is well maintained. 14. White goods are hand loaded into a large roll -off container which is transported by the contractor to their facility for CFC removal and recycling. The current contractor is Foils. Scrap metal is accumulated in this area for recycling also. Tire Collection Area: 15. Area is well maintained. 16. Scrap tire certifications are collected at the scale house and facility staff direct citizens to the tire collection area to unload tires into the trailer. The current contractor is US Tire located in Concord. 17. Five tires were observed on the ground beside the roadway to be loaded into the US Tire trailer that was delivered the day before. Records Review 18. The facility staff had the current permit and operations plan in their files. 19. Reviewed the 2nd Semi -Annual groundwater monitoring reports dated November 2018 and I't Semi -Annual groundwater monitoring reports dated March 2019. 20. Methane monitoring was being performed as required. Reviewed 3' quarter 2018 and 4t1i quarter 2018, 1" quarter 2019 and 2nd quarter 2019. 21. Random inspection reports were reviewed. Facility staff perform two (2) per week. Reviewed records from June 1, 2018 to July 15, 2019. 22. Leachate is discharged by force main to the City of Salisbury WWTP. 23.
