Harris Franklin County Manager 113 Market St. Louisburg, NC 27549 SUBJECT: Notice of Violation Compliance Inspection Report Franklin County Solid Waste Transfer Station 3501-MSWLF-1984 3503-TRANSFER- Franklin County Dear Ms. Harris: On June 13, 2019, Davy Conners, representing the State of North Carolina, Division of Waste Management Solid Waste Section (Section), and Phil Orozco with Hazardous Waste Section inspected the above referenced facility for compliance with North Carolina solid waste statutes and rules. Brain Haynesworth, Franklin County Solid Waste Director, was present and represented Franklin County Solid Waste Transfer Station during this inspection. The following violation(s) were noted and are explained in detail in the attached Inspection Report: A. 15A NCAC 13B .0402 (1) and (2), Permit Conditions -Attachment 1 Part 1 (5), and Attachment 3 Part VI (3) and (5)(b) B. 15A NCAC 13B .0402 (5) and (7), Permit Condition -Attachment 3 Part VI (7) C. Permit Condition —Attachment 3 Part VII General (1) 5_:-D_EQ�� NORTH CAROLINA ileparlment o� EnviranmanGl puaiity North Carolina Department of Environmental Quality I Division of Waste Management 217 West Jones Street 11646 Mail Service Center I Raleigh, North Carolina 27699-1646 919.707.8200 Franklin County Solid Waste Transfer Station Notice of Violation Page 2of3 July 25, 2019 Based upon the foregoing, Franklin County Solid Waste Transfer Station shall come into compliance by August 25, 2019 with all requirements of the regulations in 15A NCAC 13B .0402 (1, 2, 5 and 7); Permit Requirement Attachment 1, Part 1 (5), and Attachment 3, Part VI (3), (5) (b), (6) (a, b, c, and d), and (7) (c, d, and e), and Part VII, General (1); and Franklin County Operation Plan, Section 4.12 and 8.1 by completing the following: 1. Immediately stop breaking CRT televisions and monitors and sending CRTs to landfill. All electronic waste, including CRTs, must be recycled. Follow the state's best management practices for electronics management. 2. Immediately begin to cover transfer trailers with watertight covers either while the trailer is still in the transfer station or as soon as it leaves the transfer station. 3. Immediately begin to implement a waste screening program in accordance with the Operation Plan and Operating Permit. Retain records of all random load inspections. 4. Immediately stop piling yard waste outside of the designated yard waste collection area. Within 30 days, move and windrow all yard waste that is currently along the service road to the designated yard waste area and manage the waste in accordance with the Operation Plan and Operating Permit. The violations listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct a follow-up inspection(s) to verify that the facility has completed the requirements of this Notice of Violation.
